Regular Session, 2010 HOUSE BILL NO. 13 BY REPRESENTATIVE HOFFMANN HIGHWAYS: Provides relative to the installation of speed bumps by municipal and parish governing authorities AN ACT1 To amend and reenact R.S. 32:41(A)(13) and to enact R.S. 32:41(A)(14), relative to local2 governmental subdivision authority over traffic control on nonstate maintained3 roadways ; to authorize local governmental subdivisions to install speed bumps on4 such roadways; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 32:41(A)(13) is hereby amended and reenacted and R.S.7 32:41(A)(14) is hereby enacted to read as follows: 8 SUBPART B. POWERS OF LOCAL AUTHORITIES9 ยง41. Power of local municipal authorities10 A. [R.S. 1:13(B) and 24:177(E)] Hoffmann HB No. 13 Abstract: Expressly authorizes parishes and municipalities to install speed bumps on all public, nonstate maintained roadways within their jurisdictions. Present law defines "highway" as "every way or place of whatever nature publicly maintained and open to the use of the public for the purpose of vehicular travel...[the term is] synonymous with the word 'street'". With respect to nonstate maintained highways within their jurisdictions, present law authorizes municipalities to adopt ordinances relative to specific traffic control and regulation activities. These include: (1) Establishing speed limits and speed zones. (2) Restricting access on limited access highways. (3)Creating additional regulations controlling traffic within their boundaries under their general police power. Present law further grants parishes the same power to adopt ordinances relative to traffic control and regulation activities which is granted to municipalities. Proposed law retains present law. Proposed law expressly authorizes municipalities (and thereby indirectly authorizes parishes) to adopt ordinances installing speed bumps on any nonstate maintained roadway within its jurisdiction.
