SALES/TOBACCO TRADE:  Provides with respect to the permitting of tobacconists
AN ACT1
To amend and reenact R.S. 26:932(8) and to enact R.S. 26:901(18) and 903(6), relative to2
tobacco products; to provide for fees applicable to tobacconists; to provide for3
definitions; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 26:932(8) is hereby amended and reenacted and R.S. 26:901(18) and6
903(6) are hereby enacted to read as follows: 7
§901.  Definitions8

(18) "Tobacconist" means any bona fide tobacco retailer engaged in10
receiving bulk smoking tobacco for the purpose of blending such tobacco for retail11
sale at a particular retail outlet where fifty percent or more of the total purchases for12
the preceding twelve months were purchases of tobacco products, excluding13
cigarettes.14

(6) Tobacconist–The commissioner of alcohol and tobacco control shall18
promulgate rules to issue a single permit for bona fide Louisiana tobacconists. Such19

tobacco dealer and as a wholesale tobacco dealer. Any fee assessed for such single1
tobacconist permit shall be set at the current rate in effect on August 15, 2010.2

(8) "Tobacconist" means a retail dealer any bona fide tobacco retailer6

Abstract:  Provides for a definition of "tobacconist" and provides for a single permit for a
tobacconists to operate as a retail tobacco dealer and as a wholesale tobacco dealer.
Present law defines "tobacconist".
Proposed law (R.S. 26:932) changes the definition of "tobacconist" from "a retail dealer"to
"any bona fide tobacco retailer", and otherwise retains the definition in present law.
Proposed law (R.S. 26:901) adds a definition for "tobacconist" that is consistent with the
amended definition in proposed law (R.S. 26:932).
Proposed law provides that a single permit shall allow any bona fide La. tobacconist to
operate as a retail tobacco dealer and as a wholesale tobacco dealer.
Proposed law (R.S. 26:903) provides that any fee assessed for a tobacconist permit shall be
set at the current rate in effect on Aug. 15, 2010.
