Regular Session, 2010 HOUSE BILL NO. 1320 BY REPRESENTATIVE FANNIN CAPITAL OUTLAY: Exempts certain nonstate entity projects from the local match requirement AN ACT1 To enact R.S. 39:112(E)(2)(c), relative to capital outlay; to provide relative to the local2 match requirement for certain non-state entity projects; to exempt certain non-state3 entity projects from the local match requirement; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 39:112(E)(2)(c) is hereby enacted to read as follows: 6 ยง112. Capital outlay act7 * * *8 E.9 * * *10 (2) Non-state entity projects shall require a match of not less than twenty-11 five percent of the total requested amount of funding except:12 * * *13 (c) A project for a rural water system servicing less than one thousand14 customers to extend or connect waterlines to other water systems.15 * * *16 Section 2. This Act shall become effective upon signature by the governor or, if not17 signed by the governor, upon expiration of the time for bills to become law without signature18 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. [R.S. 1:13(B) and 24:177(E)] Fannin HB No. 1320 Abstract: Exempts certain rural water system projects from the capital outlay local match requirement. Present law requires non-state entity projects to provide a match of not less than 25% of the total requested amount of state capital outlay funding. Further provides for exceptions to this local match requirement for projects deemed by the commissioner of administration to be emergencies or projects which have demonstrated an inability to provide local matching funds. Present law requires the division of administration to promulgate rules establishing a needs- based formula for determining the inability of a non-state entity to provide the required local match. Further requires the rules to be approved by the House committees on appropriations and ways and means and the Senate committees on finance and revenue and fiscal affairs before they are promulgated. Proposed law retains present law but adds an exception to the local match requirement for a project for a rural water system servicing less than 1,000 customers to extend or connect waterlines to other water systems. Effective upon signature of governor or lapse of time for gubernatorial action. (Adds R.S. 39:112(E)(2)(c))
