CIVIL/MOTIONS:  Provides for admissibility of medical records
AN ACT1
To amend and reenact R.S. 13:3714(A), relative to evidence; to provide relative to the2
admissibility of medical records in certain circumstances; and to provide for related3
matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 13:3714(A) is hereby amended and reenacted to read as follows: 6
ยง3714. Charts or records of hospitals, and other health care providers; admissibility7
of certified or attested copy; BAC scientific analysis reports8
A.  Whenever a certified copy of the chart or record of any hospital, signed9
by the administrator or the medical records librarian of the hospital in question, or10
a copy of a bill for services rendered, medical narrative, chart, or record of any other11
state health care provider, as defined by R.S. 40:1299.39(A)(1) and any other health12
care provider as defined in R.S. 40:1299.41(A), certified or attested to by the state13
health care provider or the private health care provider, is offered in evidence in any14
court of competent jurisdiction, it shall be received in evidence by such court as15
prima facie proof of its contents, provided that the party against whom the bills,16
medical narrative, chart, or record is sought to be used may summon and examine17
those making the original of the bills, medical narrative, chart, or record as witnesses18
under cross-examination.19

Abstract: Removes cross-references to definitions of state and private health care
providers.
Present law provides that when medical records of any state health care provider, as defined
by R.S. 40:1299.39(A)(1) and any other health care provider as defined in R.S.
40:1299.41(A), is certified or attested to by the state or private health care provider, and the
record is offered in evidence in any court of competent jurisdiction, it shall be received in
evidence by such court as prima facie proof of its contents.
Proposed law retains present law but removes cross-references to the definitions of state and
private health care providers.
