UTILITIES: Provides relative to the use of agricultural waste products as a source of fuel
for the production of energy
AN ACT1
To enact Chapter 3-B of Title 45 of the Louisiana Revised Statutes of 1950, to be comprised2
of R.S. 45:151, relative to electric public utilities; to require the use of agricultural3
products and agricultural waste products as the principal source of fuel in the4
production of electricity; to require the electricity to be produced in Louisiana from5
Louisiana products; to require ten percent of the total output of electricity to be from6
agricultural products and agricultural waste products no later than January 1, 2013;7
and to provide for related matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1. Chapter 3-B of Title 45 of the Louisiana Revised Statutes of 1950,10
comprised of R.S. 45:151, is hereby enacted to read as follows: 11

ยง151. Agricultural products as fuel source required13
A. Agricultural products and agricultural waste products shall be the14
principal source of fuel used in the production of electricity by electric utilities in the15
state of Louisiana.16
B. The electricity produced by the use of agricultural products and17
agricultural waste products, pursuant to Subsection A of this Section, shall be18
produced in Louisiana from Louisiana agricultural products and agricultural waste19

C. Electric utilities providing electricity in the state of Louisiana shall1
provide at least ten percent of their total output from agricultural products and2
agricultural waste products, as required by Subsections A and B of this Section, no3
later than January 1, 2013.4
