LOBBYING: Provides relative to late filing fees applicable to a person who is an executive
branch and legislative branch lobbyist and files one report disclosing all of his
lobbying expenditures
AN ACT1
To amend and reenact R.S. 24:58(D)(1), R.S. 42:1157(A)(3), and R.S. 49:78(D)(1), relative2
to late filing fees for certain lobbyist disclosure reports; to provide for the amount3
of the late filing fees for certain lobbyist expenditure reports; and to provide for4
related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 24:58(D)(1) is hereby amended and reenacted to read as follows: 7
§58.  Enforcement8

D.  In addition to any other applicable penalties:10
(1)(a) Any person required to register and who fails to timely register and11
any person who fails to timely file any report required by this Part shall be assessed,12
pursuant to R.S. 42:1157, a late fee of fifty dollars per day.13
(b)  However, any person who fails to timely file a lobbyist expenditure14
report filed pursuant to R.S. 24:55(G) or R.S. 49:76(G) which contains all of the15
information required by this Part and Part IV of Chapter 1 of Title 49 of the16
Louisiana Revised Statutes of 1950 shall be assessed, pursuant to R.S. 42:1157, a17
late fee of fifty dollars per day.18

Section 2. R.S. 42:1157(A)(3) is hereby amended and reenacted to read as follows:1
§1157.  Late filing fees2

(3) The late filing fees for any lobbyist required to register and file reports5
under the provisions of R.S. 24:50 et seq., shall be as provided in R.S. 24:58(D). The6
late filing fees for any lobbyist required to register and file reports under the7
provisions of R.S. 49:71 et seq., shall be as provided in R.S. 49:78(D); however, the8
late filing fees applicable to a lobbyist for a lobbyist expenditure report filed9
pursuant to R.S. 24:55(G) or R.S. 49:76(G) which contains all of the information10
required by Part IV of Chapter 1 of Title 49 of the Louisiana Revised Statutes of11
1950 and all of the information required by Part III of Chapter 1 of Title 24 of the12
Louisiana Revised Statutes of 1950 shall be fifty dollars per day.13

Section 3.  R.S. 49:78(D)(1) is hereby amended and reenacted to read as follows: 15

Abstract: Provides that the late filing fees applicable to the late filing of an expenditure
report by a lobbyist who files one report disclosing all legislative and executive
branch lobbying expenditures shall be $50 per day.
Present law allows a lobbyist to file a registration or renewal of registration form that
indicates that he is registering or renewing registration for lobbying both the legislature (R.S.
24:50 et seq.) and the executive branch (R.S. 49:71 et seq.). Requires such a lobbyist to pay
both fees ($110 each for a total of $220). Present law further allows a person required by
both the legislative and executive branch lobbying provisions to file expenditure reports to
file a report which contains all of the information required by both provisions of present law.
Requires the Board of Ethics to promulgate forms which allow a lobbyist to register, renew
registration, file supplemental registration forms, and file reports pursuant to both provisions
of present law.  
Present law (R.S. 24:58(D) and R.S. 49:71(D)) provides for late fees of $50 per day for
failure to timely register or timely file any report required by present law. For being 11 or
more days late in registration or filing a report, after a hearing by the ethics board, a civil
penalty may be assessed not to exceed $10,000.
Present law (R.S. 42:1157) authorizes the staff of the ethics board to automatically assess
and order the payment of late filing fees, in accordance with rules adopted by the board, for
any failure to timely file any report or statement due under its jurisdiction pursuant to present
law.
Proposed law retains present law except provides that the late filing fees applicable to the
late filing of an expenditure report by a lobbyist who files one report disclosing all
legislative and executive branch lobbying expenditures shall be $50 per day.
