BUDGETARY CONTROL S:  Requires legislative approval of certain construction contracts
and changes to construction contracts issued by the Recovery School District
AN ACT1
To amend and reenact R.S. 17:1990(B)(1)(d), relative to the powers, duties, and functions2
of the Recovery School District, to provide relative to approval of certain3
expenditures, contracts, and changes to contracts regarding capital expenses; to4
require legislative approval; to provide relative to submission of information on such5
capital expenses to the State Board of Elementary and Secondary Education; and to6
provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 17:1990(B)(1)(d) is hereby amended and reenacted to read as9
follows: 10

(d) The school district shall not be required to utilize or obtain the approval15
of any state agency, including but not limited to the division of administration or any16
office within the division of administration or any procurement support team or17
similar group, when procuring data processing and telecommunications goods or18
services or in the procurement of materials, supplies, or major repairs or in the19

other applicable provisions of Title 39 of the Louisiana Revised Statutes of 19501
regarding such procurement and disposition of property.  	Furthermore,2
notwithstanding any provision of law to the contrary, the school district shall be3
required to receive Joint Legislative Committee on the Budget approval of any public4
works contract in excess of one hundred thousand dollars that would be considered5
a capital expense. The school district shall further receive Joint Legislative6
Committee on the Budget approval for any change order in excess of one hundred7
thousand dollars for a project undertaken that would be considered a capital expense.8
Any time the school district submits a contract or change order to the committee for9
approval pursuant to this Subparagraph, the school district shall submit the same10
information to the state board. Notwithstanding any other provision of law to the11
contrary, the school district may proceed with the contract or change order upon12
approval by the Joint Legislative Committee on the Budget.13

Abstract: Requires the Recovery School District to receive Joint Legislative Committee
on the Budget approval of capital expenses and change orders in excess of $100,000.
Present law provides for the powers, duties, and functions of the Recovery School District
(RSD). Provides that the RSD shall not be required to utilize or obtain the approval of any
state agency when procuring data processing and telecommunications goods or services or
in the procurement of materials, supplies, or major repairs or in the disposition of property.
Requires the RSD to comply with all other applicable provisions of present law (Title 39)
regarding such procurement and disposition of property.
Proposed law retains present law but requires approval of the Joint Legislative Committee
on the Budget (JLCB) of any public works contract in excess of $100,000 that would be
considered a capital expense.  Further requires JLCB approval for any change order in
excess of $100,000 for a project undertaken that would be considered a capital expense.
Proposed law requires the RSD, upon submission of a contract or change order to the JLCB,
to submit such information to BESE.  Proposed law authorizes the school district to proceed
with the contract or change order upon approval by the JLCB.
