BY REPRESENTATIVE TUCKER
BOARDS/COMMISSIONS:  Adds additional members to the Louisiana Housing Finance
Agency and provides for budget review
AN ACT1
To amend and reenact R.S. 40:600.4(A)(1) and (5) and 600.6(A)(4)(a) and to enact R.S.2
40:600.5(H) and 600.6(E), relative to the Louisiana Housing Finance Agency; to3
provide for changes to the board of commissioners; to provide for legislative4
oversight; to provide for annual reporting; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 40:600.4(A)(1) and (5) and 600.6(A)(4)(a) are hereby amended and7
reenacted and R.S. 40:600.5(H) and 600.6(E) are hereby enacted to read as follows: 8
§600.4.  Organization of the agency9
A.(1) The Louisiana Housing Finance Agency shall be governed by a board10
of commissioners composed of fifteen seventeen members.11

(5)  Two Four additional members shall be appointed as follows:13
(a)  One person Two persons appointed by the president of the Senate.14
(b) One person Two persons appointed by the speaker of the House of15
Representatives.16

§600.5.  Officers of the agency; duties; liability1

H. Notwithstanding any provisions of this Section to the contrary, the3
agency's budget shall be subject to review by the Joint Legislative Committee on the4
Budget.5
§600.6. Powers and duties of the agency6
A. The agency shall have the powers necessary or convenient to carry out and7
effectuate the purposes and provisions of this Chapter, including the following8
powers in addition to all other powers granted by other provisions of this Chapter:9

(4)(a) Adopt and amend rules and regulations of the agency in accordance11
with the Administrative Procedure Act, including those provisions which provide for12
legislative review of agency rules and regulations.  Any rule adopted by the board13
for the operation or governance of the agency shall be subject to the oversight of the14
Joint Legislative Committee on the Budget.15

E. The Louisiana Housing Finance Agency shall submit to the Louisiana17
House of Representatives and the Louisiana Senate before the fifteenth of January18
each year, a report regarding the issues related to residential housing needs19
throughout the state. 20

Abstract: Provides for changes to the board of commissioners and powers and duties of the
La. Housing Finance Agency.
Present law provides for 15 members of the La. Housing Finance Agency board of
commissioners. Present law further provides that the president of the Senate appoint one
person and the speaker of the House of Representatives appoint one person to the board of

Proposed law changes from one to two the number of members that the president of the
Senate and the speaker of the House of Representatives may each appoint and increases the
total board membership from 15 to 17.
Present law provides that the agency establish its own budget subject to the approval of 2/3
of the members of the board of commissioners.
Proposed law retains present law and further provides that the agency's budget shall be
subject to review by the Joint Legislative Committee on the Budget.
Present law provides for the agency to adopt and amend rules and regulations of the agency
in accordance with the Administrative Procedure Act, including those provisions which
provide for legislative review of agency rules and regulations. 
Proposed law retains present law and further provides that any rule adopted by the board for
operation or governance of the agency shall be subject to the oversight of the Joint
Legislative Committee on the Budget.
Proposed law provides that in the addition to the powers and duties in present law the agency
shall submit to the legislature before Jan. 15 of each year, a report regarding the issues
related to residential housing needs throughout the state.
