HEALTH: Provides authority for ambulatory surgical centers to enter into use agreements
AN ACT1
To enact R.S. 40:2133(C), 2133.1, and 2136(C), relative to ambulatory surgical centers; to2
provide for a definition of a use agreement; to provide authorization for ambulatory3
surgical centers to enter into use agreements; to provide for promulgation of rules,4
regulations, and minimum standards; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 40:2133(C), 2133.1, and 2136(C) are hereby enacted to read as7
follows: 8
§2133.  Definitions9

C. "Use agreement" means a written agreement between a licensed11
ambulatory surgical center and an individual or entity under which the ambulatory12
surgical center allows the individual or entity to use its facility, or a portion thereof,13
on a part-time basis to provide the services of an ambulatory surgical center. A use14
agreement entered into pursuant to this Part shall comply with all applicable federal15
laws and regulations.16
§2133.1.  Use Agreement17
A licensed ambulatory surgical center is hereby authorized to enter into a use18
agreement as defined in this Part.  The licensed ambulatory surgical center shall19

center under a use agreement, for compliance with all rules, regulations, and1
minimum licensing standards for ambulatory surgical centers.2

C. The licensing agency shall establish rules, regulations, and minimum6
standards for a use agreement entered into pursuant to this Part by promulgating7
rules in accordance with the Administrative Procedure Act.8

Abstract: Defines "use agreement" for ambulatory surgical centers and authorizes the
centers to enter into use agreements with individuals or entities. Provides for the
Dept. of Health and Hospitals (DHH) to promulgate rules, regulations, and minimum
standards for use agreements.
Present law provides for the definition of an "ambulatory surgical center" and provides for
licensing of ambulatory surgical centers.
Proposed law retains present law and adds a definition for a "use agreement" between an
ambulatory surgical center and another entity or individual.
Proposed law provides for authorization for an ambulatory surgical center to enter into a use
agreement and further provides that the ambulatory surgical center is still responsible for
following minimum licensing standards even during the period of the use under the
agreement.
Proposed law requires DHH to promulgate rules, regulations, and minimum standards for
use agreements according to the Administrative Procedure Act.
