DISTRICTS/NEIGHBORHOOD:  Provides relative to the Upper Hurstville Security District
in Orleans Parish
AN ACT1
To amend and reenact R.S. 33:9091.6(F)(3)(b), relative to the Upper Hurstville Security2
District in Orleans Parish; to provide relative to the renewal of parcel fees; and to3
provide for related matters.4
Notice of intention to introduce this Act has been published5
as provided by Article III, Section 13 of the Constitution of6
Louisiana.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 33:9091.6(F)(3)(b) is hereby amended and reenacted to read as9
follows:10

F. Parcel fee.  The governing authority of the city of New Orleans is hereby13
authorized to impose and collect a parcel fee within the district subject to and in14
accordance with the provisions of this Subsection:15

(b) The fee shall expire eight years after its initial levy but may be renewed19

proposition at an election as provided in Subparagraph (a) of this Paragraph.  Any1
election to authorize the renewal of the fee shall be held only at the same time as the2
mayoral primary election for the city of New Orleans. If the fee is renewed, the term3
of the imposition of the fee shall be as provided in the proposition authorizing such4
renewal, not to exceed eight years.5

Section 2. This Act shall become effective upon signature by the governor or, if not7
signed by the governor, upon expiration of the time for bills to become law without signature8
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If9
vetoed by the governor and subsequently approved by the legislature, this Act shall become10
effective on the day following such approval.11

Abstract: Provides for renewal of the Upper Hurstville Security District's parcel fee at any
election.
Present law creates the Upper Hurstville Security District in Orleans Parish.
Present law authorizes the city of New Orleans to collect a parcel fee on the property within
the district in order to fund augmented security within the district boundaries.  Present law
requires the implementation of the fee to be voted on by the registered voters of the district
at an election held in accordance with the La. Election Code. Present law further provides
that the parcel fee may be renewed if approved by a majority of the registered voters of the
district voting on the proposition.  Proposed law retains present law.
Present law requires that an election on the question of renewal may be held only at a
mayoral primary election.  Proposed law removes this requirement.
Effective upon signature of governor or lapse of time for gubernatorial action.
