CONSUMERS/PROTECTION:  Requires that a certain notice be given to a prospective
buyer prior to the purchase of a motor vehicle
AN ACT1
To enact R.S. 32:1264.1, relative to the distribution and sale of motor vehicles; to require2
that a notice regarding recalls be given to a prospective buyer prior to the purchase3
of a new motor vehicle; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:1264.1 is hereby enacted to read as follows: 6
ยง1264.1.  Notice regarding recalls7
It shall be a violation of this Chapter for a motor vehicle dealer to sell a new8
motor vehicle without first supplying a prospective buyer with the following notice:9
"A new motor vehicle may have been subject to a National Highway Traffic Safety10
Administration required recall which would be repaired in accordance with11
manufacturer standards approved by the National Highway Traffic Safety12
Administration. If such a repair is a concern before you purchase, please ask for a13
copy of the recall notice, if applicable, to the vehicle being sold."  This notice shall14
be included on the buyer's order in a box and in bold print which is signed by the15
buyer and the seller or his representative next to the box.  If the buyer requests the16
recall notice, the documents supporting the repair shall also be included in the sales17

Abstract: Requires that a notice regarding recalls be given to a prospective buyer prior to
the purchase of a new motor vehicle.
Proposed law provides that it shall be a violation for a motor vehicle dealer to sell a new
motor vehicle without first supplying a prospective buyer with the following notice: "A new
motor vehicle may have been subject to a National Highway Traffic Safety Administration
required recall which would be repaired in accordance with manufacturer standards
approved by the National Highway Traffic Safety Administration.  If such a repair is a
concern before you purchase, please ask for a copy of the recall notice, if applicable, to the
vehicle being sold." This notice shall be included on the buyer's order in a box and in bold
print which is signed by the buyer and the seller or his representative next to the box. If the
buyer requests the recall notice, the documents supporting the repair shall also be included
in the sales transaction.
