Regular Session, 2010 HOUSE BILL NO. 198 BY REPRESENTATIVE THIBAUT MTR VEHICLE/LICEN PLATES: Creates a special prestige license plate for active duty military AN ACT1 To enact R.S. 47:490.22, relative to military honor licence plates; to provide for the2 establishment of a military honor license plate for members of the United States3 Armed Forces; to provide for the design and issuance of the license plate; to4 authorize the promulgation of rules and regulations; and to provide for related5 matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 47:490.22 is hereby enacted to read as follows:8 ยง490.22. Military honor license plates; United States Armed Forces9 A. The provisions of this Section shall be applicable to the members of the10 five active-duty services and their respective guard and reserve units of the Armed11 Forces of the United States.12 B. Upon application of an active duty member of the United States Armed13 Forces, the secretary of the Department of Public Safety and Corrections shall14 establish a military honor license plate to be known as the "United States Armed15 Forces" license plate. The license plates shall be restricted to use on passenger cars,16 pickup trucks, recreational vehicles, and vans. The secretary shall design the plates,17 which shall bear the likeness of the official emblem of the United States Armed18 Forces on the left side of the license plate and the words "U.S. Armed Forces" shall19 HLS 10RS-858 ORIGINAL HB NO. 198 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. be printed across the bottom of the license plate under the numbers and the words1 "Active Duty" shall be printed underneath the words "U.S. Armed Forces".2 C. The fee for the license plate shall be the standard motor vehicle3 registration license fee.4 D. The secretary shall adopt rules and regulations to implement the5 provisions of this Section, including but not limited to rules governing the transfer6 of the license plates from one vehicle to another and the disposition of such license7 plates.8 E.(1) Any applicant who qualifies for the military honor license plate9 authorized by this Section may be issued a plate for each vehicle registered in the10 applicant's name.11 (2) Except as otherwise provided in this Subsection, each military honor12 license plate issued under this Section shall be returned to the secretary upon the13 death of the person to whom the plate was issued. A surviving spouse of a person14 to whom a license plate was issued under this Section may retain a license plate15 issued under this Section, provided the surviving spouse has not remarried and16 provided the surviving spouse applies to the secretary for a transfer of the license17 plate to the surviving spouse. A military honor license plate transferred under this18 Subsection to a surviving spouse shall be returned to the secretary upon the death or19 remarriage of the surviving spouse.20 DIGEST The digest printed below was prepared by House Legislative Services. Provides for the issuance, creation, and design of the license plate. Proposed law requires the secretary of DPS&C to issue military honor license plates for members of the U.S. Armed Forces. The license plate shall be known as the "U.S. Armed Forces" license plate. Proposed law provides for the design of the "U.S. Armed Forces" license plate. Proposed law provides that the fee shall be the regular motor vehicle license fee and the secretary shall adopt rules and regulations to implement the provisions provided in proposed law, including rules governing the transfer and disposition of such license plates. Proposed law provides that any applicant who qualifies for a U.S. Armed Forces license plate shall be issued a plate for each vehicle registered in the applicant's name. Further provides that each military honor license plate issued under the provisions of proposed law shall be returned to the secretary upon the death of the person to whom it was issued. A surviving spouse may retain the military license plate, provided the surviving spouse has not remarried and provided the surviving spouse applies for a transfer. The transferred license plate shall also be returned to the secretary upon the death or remarriage of the surviving spouse. (Adds R.S. 47:490.22)
