HOUSE BILL NO. 23

AN ACT1
To amend and reenact R.S. 14:402(D)(9) and (E)(7), relative to contraband on the grounds2
of correctional institutions; to add component hardware of telecommunications3
equipment in the definition of "contraband"; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 14:402(D)(9) and (E)(7) are hereby amended and reenacted to read6
as follows: 7
ยง402. Contraband defined; certain activities regarding contraband in penal8
institutions prohibited; penalty; disposition of seized contraband9

D.  "Contraband" as used herein means:11

(9) Any telecommunications equipment or component hardware, including13
but not limited to cellular phones, pagers, beepers, or global satellite system14
equipment, subscriber identity module (SIM) cards, portable memory chips,15
batteries, and chargers, whether or not such equipment may be intended for use in16
planning or aiding an escape or attempt to escape from any institution, unless17
authorized by the warden of the institution.18
E. It shall be unlawful to possess or to introduce or attempt to introduce into19
or upon the premises of any municipal or parish prison or jail or to take or send or20
attempt to take or send therefrom, or to give or to attempt to give to an inmate of any21
municipal or parish prison or jail, any of the following articles which are hereby22
declared to be contraband for the purpose of this Section, to wit:23

(7) Any telecommunications equipment or component hardware, including1
but not limited to cellular phones, beepers, or global positioning satellite system2
equipment, subscriber identity module (SIM) cards, portable memory chips,3
batteries, and chargers, whether or not such equipment may be intended for use in4
planning or aiding an escape or attempt to escape from any institution.5
