DRUGS:  Deletes Carisoprodol from provision of law regarding legend drugs
AN ACT1
To repeal R.S. 40:1238.1(B), relative to the sale, distribution, or possession of legend drugs2
without a prescription; to repeal provisions regarding Carisoprodol as a legend drug.3
Be it enacted by the Legislature of Louisiana:4
Section 1. R.S. 40:1238.1(B) is hereby repealed in its entirety.5

Abstract: Repeals provisions of law regarding Carisoprodol as a legend drug.
Present law defines "legend drug" as any drug or drug product bearing on the label of the
manufacturer or distributor, as required by the U.S. Food and Drug Administration, the
statement "Caution:  Federal law prohibits dispensing without prescription".
Present law provides that it shall be unlawful for any individual, while being supplied with
the legend drug Carisoprodol or a prescription for the drug by one health care practitioner,
to knowingly and intentionally obtain or seek to obtain the drug or a prescription from a
second or subsequent health care practitioner without disclosing the fact of the existing
prescription to the practitioner from whom the subsequent prescription of Carisoprodol is
being sought.
Present law also lists Carisoprodol as a controlled dangerous substance.
Proposed law repeals present law providing that Carisoprodol is a legend drug since a drug
cannot be both a legend drug and a controlled dangerous substance.
