HORTICULTURE:  Authorizes the commissioner to issue temporary arborist licenses
AN ACT1
To enact R.S. 3:3816(7), relative to arborist licenses; to provide for the issuance of2
temporary arborist licenses by the commissioner; to provide for certain temporary3
arborist license requirements; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 3:3816(7) is hereby enacted to read as follows:6
ยง3816.  Special provisions7
The following provisions shall supersede the requirements and provisions of8
this Chapter:9

(7)(a) In the event of a catastrophe and a declaration of emergency, the11
commissioner may issue a temporary arborist license authorizing a person to perform12
the measures specified by R.S. 3:3808(A).13
(b)  Applicants for a temporary arborist license shall:14
(i)  Be licensed in another state as a result of passing a state examination or15
have acquired International Society of Arboriculture (ISA) Certification.16
(ii)  Present proof of license in another state or proof of ISA Certification.17
(iii) Present a certification of insurance as provided in L.A.C.18

(c) The temporary arborist license shall be applied for within ninety days of1
the declaration of emergency and shall be in effect for a period of ninety days from2
the date of issuance.3
(d) If the holder of the temporary arborist license desires to continue4
performing measures specified in R.S. 3:3808(A) beyond the ninety-day period, he5
shall be required to obtain an arborist license through normal procedures established6
by the Louisiana Horticulture Commission for such license.7

Abstract: Authorizes the commissioner of agriculture and forestry to issue temporary
arborist licenses in the event of a catastrophe and declaration of emergency.
Proposed law provides that in the event of a catastrophe and a declaration of emergency, the
commissioner may issue a temporary arborist license authorizing a person to perform the
measures specified by present law, which are the removal of a tree or a portion of a tree,
measures to prolong the life of a tree, and measures to enhance the aesthetic value of a tree.
Proposed law requires applicants for a temporary arborist license to be licensed in another
state as a result of successful completion of a state exam or to have acquired International
Society of Arboriculture (ISA) Certification; present proof of license from another state or
proof of ISA Certification; present a certification of insurance as provided by law; and pay
a fee of $150.
Proposed law requires the temporary arborist license be applied for within 90 days of the
declaration of emergency and shall remain in effect for 90 days from date of issuance.
Further provides that if the temporary arborist licensee wishes to continue performing
arborist measures as specified by present law, he is required to obtain an arborist license
through normal licensing procedures established by the La. Horticulture Commission.
