Regular Session, 2010 HOUSE BILL NO. 252 BY REPRESENTATIVE LORUSSO MTR VEHICLE/LICEN PLATES: Creates the Washington Artillery license plate AN ACT1 To enact R.S. 47:490.22, relative to military honor license plates; to provide for the2 establishment of a military honor license plate for members of the Washington3 Artillery; to provide for the design and issuance of the license plate; to authorize the4 promulgation of rules and regulations; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 47:490.22 is hereby enacted to read as follows:7 ยง490.22. Military honor license plates; Washington Artillery8 A. The secretary of the Department of Public Safety and Corrections shall9 establish a military honor license plate to be known as the "Washington Artillery"10 plate.11 B. Upon application of a Washington Artillery member, the secretary of the12 Department of Public Safety and Corrections shall issue a military honor license13 plate to be used in lieu of a regular motor vehicle registration plate. The license14 plates shall be restricted to use on passenger cars, pickup trucks, recreational15 vehicles, and vans. The military honor license plate shall be known as the16 "Washington Artillery" license plate and shall bear a likeness of the Washington17 Artillery Battalion logo centered on the left side of the license plate and the words18 "Washington Artillery" centered on the bottom of the plate under the license plate19 HLS 10RS-346 REENGROSSED HB NO. 252 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. number and the words "TRY US" centered on the bottom of the plate under the1 words "Washington Artillery".2 C. The fee for the license plate shall be the standard motor vehicle3 registration license fee provided for in R.S. 47:463 and a handling fee of three dollars4 and fifty cents to offset a portion of the department's administrative costs.5 D. The secretary shall adopt rules and regulations to implement the6 provisions of this Section, including but not limited to rules governing the transfer7 of the license plates from one vehicle to another and the disposition of such license8 plates.9 E.(1) Any applicant who qualifies for the military honor license plate10 authorized by this Section may be issued a plate for each vehicle registered in the11 applicant's name.12 (2) Except as otherwise provided in this Subsection, each military honor13 license plate issued under this Section shall be returned to the secretary upon the14 death of the person to whom the plate was issued. A surviving spouse of a person15 to whom a license plate was issued under this Section may retain a license plate16 issued under this Section, provided the surviving spouse has not remarried and17 provided the surviving spouse applies to the secretary for a transfer of the license18 plate to the surviving spouse. A military honor license plate transferred under this19 Subsection to a surviving spouse shall be returned to the secretary upon the death or20 remarriage of the surviving spouse.21 DIGEST The digest printed below was prepared by House Legislative Services. Proposed law provides for the design of the "Washington Artillery" license plate. The plate shall bear the likeness of the Washington Artillery Battalion logo centered on the left side of the license plate and the words "Washington Artillery" centered on the bottom of the plate under the license plate number and the words "TRY US" centered on the bottom of the plate under the words "Washington Artillery". Proposed law provides that the fee shall be the regular motor vehicle license fee, plus a handling fee of $3.50 to offset the department's administrative costs. Provides that the secretary shall adopt rules and regulations to implement the provisions provided in proposed law, including rules governing the transfer and disposition of such license plates. Proposed law provides that any applicant who qualifies for a Washington Artillery license plate shall be issued a plate for each vehicle registered in the applicant's name. Further provides that each military honor license plate issued under the provisions of proposed law shall be returned to the secretary upon the death of the person to whom it was issued. A surviving spouse may retain the military license plate, provided the surviving spouse has not remarried and provided the surviving spouse applies for a transfer. The transferred license plate shall also be returned to the secretary upon the death or remarriage of the surviving spouse.
