Regular Session, 2010 HOUSE BILL NO. 283 BY REPRESENTATIVE ARNOLD TRAFFIC/VIOLATIONS: Provides that certain traffic violations be heard in certain courts AN ACT1 To enact R.S. 32:41(F) and 42(D), relative to traffic camera violations; to provide relative2 to traffic citations as a result of an automated traffic enforcement system to be heard3 in certain courts; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:41(F) and 42(D) are hereby enacted to read as follows:6 §41. Power of local municipal authorities7 * * *8 F. Any ordinances, which authorize the use of an automated traffic9 enforcement system on any public street, road, or highway and results in the issuance10 of a citation by mail, shall provide for contesting the citation in a judicial court of11 competent jurisdiction. In addition, the citation shall indicate the place and time of12 appearance to contest.13 §42. Power of local parish authorities14 * * *15 D. Any ordinances, which authorize the use of an automated traffic16 enforcement system on any public street, road, or highway and results in the17 issuance of a citation by mail, shall provide for contesting the citation in a judicial18 court of competent jurisdiction.
