CORRECTIONS:  Reduces the length of time DPS&C is required to retain certain records
AN ACT1
To amend and reenact R.S. 44:36(D), relative to public records; to reduce the time required2
for the Department of Public Safety and Corrections to retain records regarding adult3
offenders; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 44:36(D) is hereby amended and reenacted to read as follows: 6

D. All existing records or records hereafter accumulated by the Department9
of Public Safety and Corrections, Correction Services corrections services, pertaining10
to any adult offender shall be retained and may not be destroyed until after ten six11
years from the date the full term sentence imposed upon such offender expires, or six12
years from the date of death of the offender, whichever occurs first.13

Present law provides that all DPS&C records pertaining to any adult offender shall be
retained and may not be destroyed until 10 years from the date the full-term sentence

Proposed law changes present law to require the records be kept for six years from the date
the full term of the sentence imposed expires, or from the death of the offender, whichever
occurs first.
