STUDENT/SCH ATTENDANCE: Provides relative to the authority of a local school board
to deny admission or readmission to school of certain students
AN ACT1
To amend and reenact R.S. 17:221(B), relative to school attendance by certain students; to2
provide relative to the authority of a city, parish, or other local public school board3
to deny admission or readmission to school of certain students; to provide4
limitations; to delete provisions relative to a pilot program regarding school5
attendance; to provide an effective date; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 17:221(B) is hereby amended and reenacted to read as follows: 8
ยง221. School attendance; compulsory ages; duty of parents; excessive absences;9
consent to withdraw; condition for driving privileges10

B.  The state Department of Education and the Board of Elementary and12
Secondary Education shall establish a pilot program in three parish or city school13
systems selected by them for the purpose of reducing the number of children14
exhibiting habits of poor school attendance.  No city, parish, or other local public15
school board shall deny admission or readmission to school of any student of suitable16
age who resides within the geographic boundaries of the school system unless such17
student is legally excluded from attending school.18

Section 2. This Act shall become effective upon signature by the governor or, if not1
signed by the governor, upon expiration of the time for bills to become law without signature2
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If3
vetoed by the governor and subsequently approved by the legislature, this Act shall become4
effective on the day following such approval.5

Abstract: Prohibits a local school board from denying admission or readmission to school
of any student of suitable age who resides within the geographic boundaries of the
school system unless such student is legally excluded from attending school.  Also
deletes provisions relative to a pilot program to reduce the number of children
exhibiting poor school attendance habits.
Present law requires the state Dept. of Education and BESE to establish a pilot program in
three school systems to reduce the number of children exhibiting poor school attendance
habits.
Proposed law deletes present law.
Proposed law also prohibits a local school board from denying admission or readmission to
school of any student of suitable age who resides within the geographic boundaries of the
school system unless such student is legally excluded from attending school.
Effective upon signature of governor or lapse of time for gubernatorial action.
