DISTRICTS/DRAINAGE:  Provides relative to the governing board of Consolidated
Gravity Drainage District No. 1 of Tangipahoa Parish
AN ACT1
To enact R.S. 38:1794(B)(3), relative to Tangipahoa Parish; to provide relative to2
Consolidated Gravity Drainage District No. 1; to provide relative to the governing3
board of the district; to provide relative to the schedule of meetings held by the4
board; to provide relative to the compensation and reimbursement of board members;5
and to provide for related matters.6
Notice of intention to introduce this Act has been published7
as provided by Article III, Section 13 of the Constitution of8
Louisiana.9
Be it enacted by the Legislature of Louisiana:10
Section 1.  R.S. 38:1794(B)(3) is hereby enacted to read as follows:11

(3) Notwithstanding any other provision of law to the contrary, the16
provisions of this Paragraph shall apply to the board of commissioners of17
Consolidated Gravity Drainage District No. 1 of Tangipahoa Parish:18
(a) The board of commissioners of the district shall, by resolution, fix a time19

meetings in every month. Special meetings may be held at such times and places as1
specified by call of any commissioner or the secretary of the board.2
(b)(i) Members of the board of commissioners of the district may receive3
compensation of not more than five hundred dollars per month, as determined by the4
board of commissioners, for performing the duties imposed upon a member by virtue5
of his appointment.6
(ii) The board of commissioners may reimburse any member for expenses7
actually incurred in the attendance of meeting or in the performance of duties on8
behalf of the district which occur outside of the district.9
(iii) Any increase in compensation or reimbursement for expenses of any10
kind to members of the board of commissioners shall be approved by two-thirds vote11
of the membership of the board of commissioners after holding a public hearing on12
such matter. The public hearing shall be advertised in the official journal of the13
district on at least two separate occasions within a period of fifteen days preceding14
the meeting at which the public hearing is held and the vote is taken.15
(c) Except as provided in Item (b)(iii) of this Paragraph, all expenses of16
administration, salaries of officers, and other expenses shall be paid by the treasurer17
out of the funds of the district after any such expense has been approved at a meeting18
of the board of commissioners.19
(d) The provisions of Subparagraph (2)(b) of this Subsection shall not apply20
to the board of commissioners of the district.21
Section 2. This Act shall become effective on July 1, 2010; if vetoed by the governor22
and subsequently approved by the legislature, this Act shall become effective on July 1,23

Abstract: Provides relative to the governing board of Consolidated Gravity Drainage
District No. 1 of Tangipahoa Parish. Provides relative to the schedule of meetings
held by the board and the compensation and reimbursement of board members.
Present law generally authorizes police juries to create gravity drainage districts. Provides
generally that the districts shall be governed by five commissioners appointed by the police
jury.  Further provides with respect to the powers and duties of such districts.
Proposed law retains present law.
Present law generally requires the board of commissioners of drainage districts to hold at
least one meeting in every year as fixed and determined by resolution of the board.
Authorizes any commissioner or the secretary of the board to call special meetings.
Proposed law makes an exception for the board of commissioners of Consolidated Gravity
Drainage District No. 1 of Tangipahoa Parish. Requires the board to hold at least two
regular meetings in every month.  	Proposed law otherwise retains present law.
Present law generally provides that members of the board of commissioners are authorized
to receive compensation of not more than $150 per day as determined by the board for each
day of attendance at regular or special meetings of the board . Prohibits members from
being paid for more than 36 days in one year.
Proposed law retains present law but makes an exception for the board of commissioners of
Consolidated Gravity Drainage District No. 1 of Tangipahoa Parish.  Authorizes members
of the board to receive compensation of not more than $500 per month as determined by the
board for performing their duties.
Present law generally authorizes the board of commissioners to reimburse members for any
expenses actually incurred in performing their duties.
Proposed law retains present law but authorizes the board of commissioners of Consolidated
Gravity Drainage District No. 1 to reimburse any member for expenses actually incurred in
the attendance of meetings or in the performance of duties on behalf of the district which
occur outside of the district.
Present law generally provides that any increase in compensation or reimbursement for
expenses of any kind to members of the board of commissioners shall be approved by 2/3
vote of the membership of the board after holding a public hearing on the issue. Requires
that the public hearing be advertised in the official journal of the district on at least two
separate occasions within a period of 15 days preceding the meeting at which the vote is
taken.
Proposed law retains present law and its applicability to Consolidated Gravity District No. 1.
Present law requires that all expenses of administration, salaries of officers, etc., be paid by
the treasurer out of the funds of the district. Provides that such expenses shall be paid only
