Regular Session, 2010 HOUSE BILL NO. 554 BY REPRESENTATIVE DANAHAY CRIMINAL/PROCEDURE: Prohibits release on own recognizance for domestic abuse battery AN ACT1 To amend and reenact Code of Criminal Procedure Article 334.2, relative to bail; to provide2 that a person arrested for domestic abuse battery shall not be released on his own3 recognizance; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. Code of Criminal Procedure Article 334.2 is hereby amended and6 reenacted to read as follows: 7 Art. 334.2. Present law provides that any defendant who has been arrested for a crime of violence shall not be released on his own recognizance. Proposed law retains present law, and further provides that any defendant who has been arrested for domestic abuse battery shall not be released on his own recognizance. (Amends C.Cr.P. Art. 334.2)
