CRIMINAL/PROCEDURE: Prohibits release on own recognizance for domestic abuse
battery
AN ACT1
To amend and reenact Code of Criminal Procedure Article 334.2, relative to bail; to provide2
that a person arrested for domestic abuse battery shall not be released on his own3
recognizance; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  Code of Criminal Procedure Article 334.2 is hereby amended and6
reenacted to read as follows: 7
Art. 334.2. Arrest for a crime of violence or domestic abuse battery; release on own8
recognizance prohibited9
Notwithstanding any other provision of law to the contrary, the court shall10
not release any defendant on his own recognizance or on the signature of any other11
person without posting bail, who has been arrested for domestic abuse battery or for12
a crime of violence as defined in R.S. 14:2(B).13 HLS 10RS-240	ENGROSSED

Abstract: Provides that any defendant who has been arrested for domestic abuse battery
shall not be released on his own recognizance. 
Present law provides that any defendant who has been arrested for a crime of violence shall
not be released on his own recognizance.
Proposed law retains present law, and further provides that any defendant who has been
arrested for domestic abuse battery shall not be released on his own recognizance.
