HOUSE BILL NO. 582

AN ACT1
To amend and reenact R.S. 39:1659 and 40:1300.281(F), relative to prosthetic and orthotic2
services; to provide for exceptions; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 39:1659 is hereby amended and reenacted to read as follows: 5
§1659. Purchase of prostheses, orthoses, prosthetic services, and orthotic services6
by a state agency from an accredited facility7
Notwithstanding any other provision of law to the contrary, regulations8
promulgated by the commissioner of administration or other purchasing entity9
governing the purchase of prostheses, orthoses, prosthetic services, or orthotic10
services shall require that such services shall only be purchased be purchased only11
from an accredited facility as provided in R.S. 40:1300.281.  However; however,12
nothing in this Section shall prohibit a licensed occupational therapist or a licensed13
physical therapist from practicing within his scope of practice.  In addition, the14
provisions of this Section shall not apply to a licensed optometrist	, or15
ophthalmologist, podiatrist, or orthopedist.16
Section 2. R.S. 40:1300.281(F) is hereby amended and reenacted to read as follows:17
§1300.281.  Purchase of prostheses, orthoses, prosthetic services, and orthotic18
services by a state agency from an accredited facility; Medicaid19
reimbursement; definitions; penalties20
