MOTOR VEHICLES:  Limits liability during funeral processions
AN ACT1
To amend and reenact R.S. 32:300.3(D), relative to motor vehicles; to limit liability of law2
enforcement agencies involved in funeral processions; and to provide for related3
matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:300.3(D) is hereby amended and reenacted to read as follows:6
ยง300.3.  Funeral processions7

D. This Section shall not create a cause of action or substantive legal rights9
against any funeral home, its director, or any of its employees or agents, or any law10
enforcement agency or officer. Furthermore, a funeral home, its director, or any of11
its employees or agents, or any law enforcement agency or officer shall not be held12
liable for a violation of this Section if the operator of a motor vehicle fails to exercise13
due care while participating in a funeral procession.14

Abstract: Limits liability of law enforcement agencies involved in funeral processions.
Present law provides for the definition of "funeral procession" and procedure for motor
vehicles participating in a "funeral procession".
Proposed law retains present law.
Present law provides that procedure for motor vehicles participating in funeral processions
contained in present law shall not create a cause of action or substantive legal rights against
any funeral home, its director, or any of its employees or agents. Furthermore, such persons
shall not be held liable for a violation of procedure for motor vehicles participating in funeral
processions.
Proposed law applies present law to any law enforcement agency or officer.
