TRANSPORTATION:  Makes changes to "Road Show" hearings process
AN ACT1
To amend and reenact R.S. 48:231(A) and (B)(1), relative to the highway priority2
construction program; to provide for scheduling of public hearings; to provide for3
notice requirements; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 48:231(A) and (B)(1) are hereby amended and reenacted to read as6
follows:7
ยง231. Final construction program for current fiscal year; public hearings; Joint8
Highway Priority Construction Committee; reports; review by legislature;9
restrictions on legislature10
A.  Prior to the convening of each regular session of the legislature, the11
department shall hold public hearings in each highway district for the purpose of12
reviewing priorities for the coming fiscal year. A report based on the testimony13
received at said hearings shall be sent to the Joint Highway Priority Construction14
Committee. The department then shall create the final construction program for the15
coming fiscal year for submission to the legislature. When this final construction16
program is communicated to the legislature for funding for the coming fiscal year,17
any project which the legislature determines is not in the proper order of priority in18
accordance with the factors stated in R.S. 48:229 may be deleted by the legislature.19

construction program, nor shall the legislature make substitutions for projects which1
have been removed.2
B.(1) The Joint Highway Priority Construction Committee shall be3
comprised of the entire membership of the House and Senate transportation,4
highways and public works committees and shall include legislators representing the5
parishes within the respective highway district for the purposes of attending the6
public hearings in each district as required in Subsection A of this Section.7
Notwithstanding any unforseen circumstances, the department shall provide notice,8
via electronic transmission, to each member of the Joint Highway Priority9
Construction Committee and legislators representing the parishes within the10
respective highway district, fifteen calendar days prior to each public hearing in each11
highway district as required in Subsection A of this Section. Beginning in 2004, the12
chairman of the House transportation, highways and public works committee13
Transportation, Highways and Public Works Committee shall serve as chairman of14
the Joint Highway Priority Construction Committee. Thereafter, chairmanship of the15
Joint Highway Priority Construction Committee shall rotate between the chairman16
of the House and Senate transportation, highways and public works committees on17
a two-year basis.18

Summary of Amendments Adopted by House
Committee Amendments Proposed by House Committee on Transportation, Highways
and Public Works to the original bill.
1. Removed requirement that hearings be held between Oct. 1 and Nov. 30 of each
year and reinstated language that hearings be held prior to the legislative session.
2. Changed proposed law notice requirement from 30 days to 15 calendar days,
notwithstanding any unforeseen circumstances, and also requires such notice be
sent by electronic transmission.
