ENROLLED Page 1 of 2 ACT No. 109 Regular Session, 2010 HOUSE BILL NO. 587 BY REPRESENTATIVE GARY SMITH AN ACT1 To authorize and provide for the transfer or lease of certain state property in St. Charles2 Parish to the Pontchartrain Levee District from the Department of Transportation and3 Development; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. The secretary of the Department of Transportation and Development and6 the commissioner of the division of administration, notwithstanding any other provision of7 law to the contrary, is hereby authorized and empowered to convey, transfer, assign, lease,8 and deliver any interest, excluding mineral rights, the state may have to the following9 described properties to the Pontchartrain Levee District:10 PARCEL UR16-26:11 Beginning at a point located on Vendor's most western property line, said12 point being coexistent with the point located on the easterly existing right of13 way line of Magazine Blvd., St. Charles, Louisiana, said point being more14 fully described as being located approximately 489.85 feet north 21° 17' 39"15 West, opposite Highway Survey Station project no. 450-36-03 (Route I-310);16 thence proceed from this point of beginning along Vendor's western property17 line North 21° 17' 38" West, a distance of 143.92 feet; thence proceed along18 Vendor's most northerly property line, a distance of 177.29 feet in a19 southeasterly direction to Vendor's eastern property line; thence proceed20 along Vendor's eastern property line South 21°03' 24" East, a distance of21 35.85 feet; thence proceed along the arc of a curve having a radius of22 3,234.04 feet (the chord which bears South 70° 10' 54" West, a distance of23 137.65 feet (a distance of 137.66 feet) to point of beginning. Said parcel of24 land contains an area of 0.286 acre.25 PARCEL NO. UR-22-5:26 Beginning at a point located approximately 442.20 feet (52.36 feet plus27 135.16 feet plus 254.63 feet) north 19° 52' 11" West opposite Highway28 Survey Stations 66 + 99.30 to the left or northerly side of the centerline of29 Airline Highway (La-US 61), St. Charles Parish, State of Louisiana; thence30 proceed along Vendor's southern property line, said line being co-existent31 with the northern existing right of way line of Willow Street, North 52° 52'32 24" East a distance of 168.90 feet to point of beginning; thence proceed33 along the arc of a curve having a radius of 1,387.40 feet (North 30° 20' 07"34 West a distance of 322.97 feet) a distance of 323.70 feet; thence proceed35 along the arc of a curve having a radius of 671.20 feet (the chord which bears36 North 5° 22' 55" West a distance of 420.83 feet) a distance of 428.04 feet;37 thence proceed along Vendor's most northern property line North 49° 17' 49"38 ENROLLEDHB NO. 587 Page 2 of 2 East a distance of 27.97 feet; thence proceed along Vendor's most eastern1 property line South 17° 24' 11" East a distance of 722.72 feet; thence proceed2 along Vendor's most southern property line, said line being co-existent with3 the northern existing right of way line of Willow Street, South 52° 52' 24"4 West a distance of 43.62 feet to point of beginning. Said parcel of land5 contains an area of 1.477 acres.6 Section 2. The secretary of the Department of Transportation and Development and7 the commissioner of the division of administration, on behalf of the state of Louisiana, is8 hereby authorized to enter into such agreements, covenants, conditions, and stipulations and9 to execute such documents as are necessary to properly effectuate any conveyance, transfer,10 assignment, lease, or delivery of title, excluding mineral rights, to the properties described11 in Section 1 herein, and as more specifically described in any such agreements entered into12 and documents executed by and between the secretary of the Department of Transportation13 and Development, the commissioner of the division of administration and the Pontchartrain14 Levee District, in exchange of consideration proportionate to the appraised value of the15 property.16 Section 3. This Act shall become effective upon signature by the governor or, if not17 signed by the governor, upon expiration of the time for bills to become law without signature18 by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana.
