VOTERS/VOTING: Provides relative to assistance in voting
AN ACT1
To amend and reenact R.S. 18:564(B)(5)(b) and 1309.3(B)(4)(b), relative to assistance in2
voting; to provide procedures for assisting certain voters on election day and during3
early voting; to repeal the requirement that a person assisting such a voter present4
certain identification; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 18:564(B)(5)(b) and 1309.3(B)(4)(b) are hereby amended and7
reenacted to read as follows:8

(b) Except for a commissioner, the person assisting the voter shall present15
to the commissioners his Louisiana driver's license, his Louisiana special16
identification card issued pursuant to R.S. 40:1321, or other generally recognized17
picture identification card that contains the name and signature of the person18
assisting the voter. The commissioners shall write the voter's name in the precinct19

voter behind the tab for Assistance to Voters. The person, including a commissioner,1
assisting the voter shall sign his name behind the tab for Assistance to Voters.2

(b) Except for a registrar or deputy registrar, the person assisting the voter10
shall present to the registrar or deputy registrar his Louisiana driver's license, his11
Louisiana special identification card issued pursuant to R.S. 40:1321, or other12
generally recognized picture identification card that contains the name and signature13
of the person assisting the voter. The registrar or deputy registrar shall write the14
voter's name in the precinct register or list kept by the registrar and the name of the15
person assisting the voter behind the tab for Assistance to Voters. The person16
assisting the voter, including a registrar or deputy registrar, shall sign his name17
behind the tab for Assistance to Voters.18

Section 2. This Act shall become effective upon signature by the governor or, if not20
signed by the governor, upon expiration of the time for bills to become law without signature21
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If22
vetoed by the governor and subsequently approved by the legislature, this Act shall become23

Abstract: Repeals the requirement that a person assisting a voter to vote on election day
or during early voting present certain identification.
Present law (R.S. 18:564 and 1309.3) provides for assistance in voting. Requires a person
who needs assistance in voting to provide to the registrar or to the commissioners on election
day certain information as proof of disability. Specifies the types of information required.
Restricts persons who can provide assistance to the voter at the polls on election day and
during early voting. Requires the commissioners to write the voter's name in the precinct
register and write the name of the person, including a commissioner, assisting the voter
behind the tab for "Assistance to Voters". Requires the person, including a commissioner,
assisting the voter to sign his name behind the tab for "Assistance to Voters". Proposed law
retains present law.
Proposed law requires a person assisting a voter, except an election commissioner, to present
his La. driver's license, his La. special identification card, or other generally recognized
picture identification card that contains the name and signature of the person assisting the
voter. Proposed law repeals present law.
Effective upon signature of governor or lapse of time for gubernatorial action.
