Regular Session, 2010 HOUSE BILL NO. 679 BY REPRESENTATIVE ABRAMSON GAMING/CASINO: Provides relative to the execution of the casino support services contract AN ACT1 To amend and reenact R.S. 27:247, relative to the casino support services contract; to2 provide for the execution of such contract; to repeal provisions requiring approval3 of a legislative committee; to require legislative appropriation to fully fund the4 contract; to provide for an effective date; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 27:247 is hereby amended and reenacted to read as follows: 7 ยง247. Casino support services contract8 Subject to and in accordance with the provisions of this Chapter, the gaming9 control board shall enter into a casino support services contract with the governing10 authority of the parish where the official gaming establishment is located in order to11 compensate the parish on a quarterly basis for the cost to the parish for providing12 support services resulting from the operation of the official gaming establishment13 and the activities therein. Support services as used in this Section shall include but14 not be limited to fire, police, sanitation, health, transportation, and traffic services.15 The amount of the contract shall be determined by negotiation and agreement16 between the gaming control board and the parish, subject to approval by the Joint17 Legislative Committee on the Budget. In the event that a new contract is not agreed18 upon by the gaming control board and the parish by March thirty-first of any year,19 the contract currently in effect shall be submitted to the Joint Legislative Committee20 on the Budget for approval of the amount of the contract at the next meeting of the21 committee. If the committee disapproves or does not act upon1 the amount of the contract, the contract shall be null, void, and of no effect most2 recently approved contract shall remain in full force and effect. The Legislature of3 Louisiana shall make an annual appropriation for the full amount of compensation4 negotiated in the contract.5 Section 2. This Act shall become effective upon signature by the governor or, if not6 signed by the governor, upon expiration of the time for bills to become law without signature7 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If8 vetoed by the governor and subsequently approved by the legislature, this Act shall become9 effective on the day following such approval.10 DIGEST The digest printed below was prepared by House Legislative Services. Present law provides that the gaming control board and the governing authority enter into a casino support services contract to compensate the governing authority for cost of services resulting from the operation of the land-based casino. The amount of the contract is subject to approval by the Joint Legislative Committee on the Budget. Proposed law deletes the requirement for approval of the amount of the contract by the Joint Legislative Committee on the Budget. Present law further provides that if a new contract is not agreed upon by March 31 of any year, the current contract shall be submitted to the committee for approval of the amount of the contract at its next meeting. If the committee approves the amount, the current contract shall continue in force. If the committee disapproves the amount, the contract is null. Present law provides that any payment required by the approval of the amount of the contract shall be subject to appropriation by the legislature. Proposed law deletes the provisions making the contract continuation contingent on approval by the Joint Legislative Committee on the Budget. Proposed law further requires the legislature to annually approve the full amount of the contract. Effective upon signature of governor or lapse of time for gubernatorial action. (Amends R.S. 27:247)
