Regular Session, 2010 HOUSE BILL NO. 691 BY REPRESENTATIVE ROSALIND JONES AND SENATOR WALSWORTH MTR VEHICLE/DEALERS: Provides for changes to fees charged by the La. Used Motor Vehicle Commission AN ACT1 To amend and reenact R.S. 32:791(A)(1) and (D) and 802(E), (F), and (G) and to enact R.S.2 32:784(A)(5) and (D), relative to fees charged by the Louisiana Used Motor Vehicle3 Commission; to provide for fees for rental motor vehicle dealers; to provide for fees4 on off-premises permits; to increase the licensing fees on licenses issued by the5 commission; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 32:791(A)(1) and (D) and 802(E), (F), and (G) are hereby amended8 and reenacted and R.S. 32:784(A)(5) and (D) are hereby enacted and to read as follows: 9 §784. Dealers, manufacturers, and distributors to be licensed; exception10 A. No person, firm, or corporation, unless licensed to do so by the11 commission under the provisions of this Chapter, shall carry on or conduct the12 business of:13 * * *14 (5) Rental dealer as defined in R.S. 32:793(A)(5).15 * * *16 D. The commission shall issue off-1 premises permits in accordance with rules and regulations authorizing the display of2 up to five vehicles at an event within thirty-five miles of the dealer's place of3 business for a period of up to three days for a fee of one hundred twenty-five dollars4 per permit.5 * * *6 §791. Application for license; fee; educational seminar; bond requirements; liability7 insurance; salesperson's license; location of business8 A.(1) It shall be unlawful and shall constitute a misdemeanor for any person,9 firm, association, corporation, limited liability company, or trust to engage in10 business as, or serve in the capacity of, or act as a used motor vehicle dealer, rental11 dealer, or used motor vehicle salesperson in this state without first obtaining a12 license therefor as provided in this Section.13 * * *14 D. The schedule of license fees to be charged and received by the15 commission for the licenses issued hereunder shall be as follows:16 (1) For each used motor vehicle dealer's license and for each rental dealer's17 license, a maximum of two three hundred dollars per year for an applicant's18 established place of business.19 (2) For a used motor vehicle dealer's license and for each place of business20 in addition to the principal place of business, one two hundred dollars per year.21 (3) For each duplicate license, a fee of one hundred dollars.22 (4) For each used motor vehicle salesperson's license, no more than twenty-23 five dollars.24 * * *25 HLS 10RS-1582 ENGROSSED HB NO. 691 Page 3 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. §802. License required; application; fee; duration1 * * *2 E. Every application for license as a dismantler and parts recycler, dismantler3 and parts recycler salesperson, or motor vehicle crusher shall be accompanied by the4 following fee:5 (1) A maximum of two three hundred dollars per year for an applicant's6 established place of business.7 (2) One Two hundred dollars per year for each place of business in addition8 to the principal place of business.9 (3) For each duplicate license, a fee of one hundred dollars.10 F. All bonds and licenses issued under the provisions of this Part shall expire11 on December thirty-first of each year the date indicated on the license and shall be12 nontransferable.13 G. All applications for renewal of licenses hereunder shall be submitted on14 or before sixty days prior to December thirty-first of each year the expiration date15 indicated on the license. If application has not been made for renewal of licenses,16 such licenses shall expire on December thirty-first of the following year the17 expiration date indicated on the license, and it shall be a violation of this Part for any18 person to represent himself and act thereafter in the capacity and business for which19 he was formerly licensed hereunder.20 * * *21 DIGEST The digest printed below was prepared by House Legislative Services. Present law provides for the licensing of used motor vehicle dealers, a used parts dealer, a dismantler and parts recycler, and auctions and salvage pools that deal in used motor vehicles. Proposed law retains present law but includes the licensing of rental motor vehicle dealers. Proposed law requires that a facility licensed by the commission to get a $125 permit to display a used motor vehicle off-premises. Present law provides that the licensing fees for a used motor vehicle dealer or used motor vehicle salesperson are as follows: (1)A maximum of $200 for each used motor vehicle dealer's license. (2)$100 for each place of business in addition to the principal. (3)$25 for each used motor vehicle salesperson's license. Proposed law changes present law to include rental motor vehicle dealers and increases the fees of the used motor vehicle dealer license from $200 to $300 and for each additional business location from $100 to $200. Proposed law provides for a duplicate license fee of $100. Present law provides for the licensing fees of dismantler and parts recylers, dismantler and parts recycler salespersons, or motor vehicle crushers to be as follows: (1)A maximum of $200 for an applicant's established place of business. (2)$100 for each additional place of business. Proposed law changes present law to increase the maximum fee on the place of business from $200 to $300 and the additional place of business from $100 to $200. Proposed law provides for a duplicate license fee of $100. Present law provides that renewals of license be submitted at least 60 days prior to Dec. 31 of each year and that the expiration be Dec. 31 of the following year. Proposed law changes present law to provide that the license shall be submitted by the expiration date indicated on the license and that the license expires on the date indicated on the license. (Amends R.S. 32:791(A)(1) and (D) and 802(E), (F), and (G); Adds R.S. 32:784(A)(5) and (D))
