BY REPRESENTATIVES WOOTON, HARRISON, AND HUTTER
FISHING/OYSTERS: Allows the sale within the state of La. of oysters for raw
consumption at all times of the year
AN ACT1
To enact R.S. 56:437, relative to the sale of oysters; to authorize the sale for raw2
consumption of oysters which have been harvested from Louisiana waters; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 56:437 is hereby enacted to read as follows:6
ยง437.  Sale of oysters for raw consumption within the state7
Oysters which have been harvested from Louisiana waters may be sold for8
raw consumption within the state at all times during the year.  Federal regulations9
which may prohibit the interstate transportation and sale of oysters which have not10
been post-harvest treated shall not apply to oysters harvested, sold, and consumed11
within the state of Louisiana. The Department of Health and Hospitals shall12
promulgate rules pursuant to the Administrative Procedure Act to administer the13
provisions of this Section and the Department of Wildlife and Fisheries shall assist14

Proposed law provides that oysters harvested from La. waters may be sold for raw
consumption within the state at all times during the year. Further provides that federal
regulations which may prohibit the interstate transportation and sale of oysters which have
not been post-harvest treated shall not apply to oysters harvested, sold, and consumed within
the state of La.
Proposed law authorizes the Dept. of Health and Hospitals to promulgate rules and
regulation to administer proposed law and authorizes the Dept. of Wildlife and Fisheries to
enforce such rules and regulations.
