HOUSING/MANUFACTURED:  Provides relative to manufactured housing
AN ACT1
To amend and reenact R.S. 51:911.41 and 912.26, relative to manufactured housing; to2
provide that the codes and standards in state law and adopted by the Louisiana3
Manufactured Housing Commission are minimum standards for construction and4
installation of manufactured housing; to provide that state law does not preclude5
local installation requirements that enhance safety or local development standards6
that do not negatively impact safety; and to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 51:911.41 and 912.26 are hereby amended and reenacted to read as9
follows: 10
§911.41.  Supremacy of the Part11
Notwithstanding any provision of law to the contrary, the The codes and12
standards referenced in R.S. 51:911.21 et seq. and R.S. 51:912.21 et seq. and those13
adopted by the commission shall be the only minimum construction and installation14
standards used for manufactured housing in Louisiana, and these standards shall15
preempt all local standards as they relate to the construction and installation of16
manufactured housing and manufactured homes in Louisiana.17

§912.26.  Local installation standards preempted1
The manufactured home installation standards provided for in this Part shall2
preempt all not preclude local installation requirements which enhance safety or3
development standards which do not negatively impact safety, including but not4
limited to local ordinances requiring: the pier foundation to be a solid concrete pad5
or equivalent, precast or poured in place, or approved material by the regulatory6
agency to be larger than the minimum requirements set forth in R.S. 51:912.22(4),7
installation of skirting or coverings, or the sewer and utility connections to be located8
in a specific area.9

installation standards used for manufactured housing in La., and these standards shall
preempt all local standards as they relate to the construction and installation of manufactured
housing and manufactured homes in La.
Proposed law provides that the codes and standards referenced in proposed law and those
adopted by the commission shall be the minimum construction and installation standards
used for manufactured housing in La.
Present law provides that the manufactured home installation standards provided for in
present law shall preempt all local installation standards.
Proposed law provides that the manufactured home installation standards provided for in
proposed law shall not preclude local installation requirements which enhance safety or
development standards which do not negatively impact safety, including but not limited to
local ordinances requiring: the pier foundation to be a solid concrete pad or equivalent,
precast or poured in place, or approved material by the regulatory agency to be larger than
the minimum requirements set forth in present law, installation of skirting or coverings, or
