Regular Session, 2010 HOUSE BILL NO. 70 BY REPRESENTATIVE GEYMANN ECONOMIC DEVEL/COMMUNITY: Creates the Wards 4 and 6 Economic Development Board in Beauregard Parish AN ACT1 To enact Subpart B-4-A of Title 33 of the Louisiana Revised Statutes of 1950, to be2 comprised of R.S. 33:130.81 through 130.83, relative to the Wards 4 and 6 Economic3 Development Board in Beauregard Parish; to establish the board; to provide for4 appointment of members to the board; to provide the powers and duties of the board;5 and to provide for related matters.6 Notice of intention to introduce this Act has been published7 as provided by Article III, Section 13 of the Constitution of8 Louisiana.9 Be it enacted by the Legislature of Louisiana:10 Section 1. Subpart B-4-A of Title 33 of the Louisiana Revised Statutes of 1950,11 comprised of R.S. 33:130.81 through 130.83, is hereby enacted to read as follows: 12 SUBPART B-4-A. WARDS 4 AND 6 ECONOMI C DEVELOPMENT BOARD OF13 BEAUREGARD PARISH14 §130.81. Wards 4 and 6 Economic Development Board of Beauregard Parish;15 creation; purpose16 The Wards 4 and 6 Economic Development Board of Beauregard Parish is17 hereby created. These activities include but shall not be limited to endeavors that will1 accomplish or enhance the opportunity for any of the following:2 (1) Growth, development, and prosperity of the wards 4 and 6 area.3 (2) Development of existing commercial structures.4 (3) Development of underutilized resources.5 (4) Development of the tax base.6 (5) Coordination of public and private programs.7 §130.82. Composition of the board8 A. The Wards 4 and 6 Economic Development Board of Beauregard Parish9 shall be composed of members selected as follows:10 (1) One member shall be appointed by the Louisiana state senator or senators11 who represent any part of ward 4 or 6 of Beauregard Parish.12 (2) One member shall be appointed by the Louisiana state representative or13 representatives who represent any part of ward 4 or 6 of Beauregard Parish.14 (3) One member shall be appointed by the Beauregard Parish School Board15 member or members who represent any part of ward 4 or 6 of Beauregard Parish.16 (4) Four members shall be appointed by the member or members of the17 governing authority of Beauregard Parish who represent any part of ward 4 or 6 of18 Beauregard Parish.19 B.(1) Members shall serve four-year terms after initial terms as provided in20 Paragraph (2) of this Subsection.21 (2) One member shall serve an initial term of one year; two shall serve an22 initial term of two years; two shall serve an initial term of three years; and two shall23 serve initial terms of four years. The initial terms of the respective members shall24 be determined by lot at the first meeting of the board.25 C. Members shall serve without compensation.26 D. Any vacancy in the membership of the board shall be filled in the manner27 of the original appointment. Any member of the board may be removed by a majority vote of the3 board, but only for cause on charges proffered against him in writing and after public4 hearing. Any member so removed shall have the right to appeal his removal to a5 court of competent jurisdiction within ten days of the decision ordering his removal.6 F. Members shall be eligible for reappointment, unless they have been7 removed from office in the manner provided in this Section.8 §130.83. Powers and functions of the board9 The board shall have the following powers and functions:10 (1) Make recommendations and provide relevant information about the11 wards 4 and 6 area concerning such matters as:12 (a) Natural and environmental conditions, trends of industrial population,13 developments, and the culture of the people.14 (b) Land use in the area.15 (c) The need for and the proposed general locations of commercial, mixed16 use, public, or private works and facilities in the area.17 (2) Make or assist in studies of the resources of the wards 4 and 6 area and18 the problems affecting the development of the area, and make such studies available19 to the public. In making such studies the board may seek assistance from public or20 private sources.21 (3) Prepare, maintain, and make available listings of the resources of the22 wards 4 and 6 area and of the major public and private works which affect the23 development of the area.24 (4) Provide information in order to foster public awareness and25 understanding of the purpose of the board and to stimulate public interest and26 participation in the development of the area.27 (5) Accept the donation of public or private grants and services.28 HLS 10RS-535 ORIGINAL HB NO. 70 Page 4 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (6) Solicit the assistance of industry and private civic organizations in the1 control and reduction of litter in the area, and encourage participation in the "adopt-2 a-road" program as provided in R.S. 48:235 for the purpose of controlling litter along3 the highways of the area.4 (7) Hold public hearings and sponsor public forums.5 (8) Exercise all other powers necessary and proper for the discharge of its6 function.7 DIGEST The digest printed below was prepared by House Legislative Services. Proposed law creates the Wards 4 and 6 Economic Development Board of Beauregard Parish to promote, encourage, and participate in economic development in the area. Proposed law creates a seven-member board, the members of which shall serve staggered terms of four years. Appointments to the board are made as follows: (1)One member appointed by the La. state senator or senators who represent any part of the wards. (2)One member appointed by the La. state representative or representatives who represent any part of the wards. (3)One member appointed by the Beauregard Parish School Board member or members who represent any part of the wards. (4)Four members appointed by the parish governing authority by the member or members who represent any part of the wards. Proposed law further states that board members shall serve without compensation. Any vacancy on the board shall be filled in the same manner as the original appointment. Proposed law also provides that any board member may be removed by a majority vote of the board, but only for cause after written charges have been proffered against him and a public meeting has been held. Proposed law further provides that members may be reappointed, unless they have been removed for cause as provided in proposed law. Proposed law also provides the powers and functions of the board: (1)Make recommendations and provide information about the following: (a)Environment, industry, development, and the people of the area. (4)Foster public awareness of the board and its purpose of developing the area. (5)Accept grants or services from public or private sources. (6)Reduce litter in the area with the cooperation of private industry and organizations. (7)Hold public hearings. (8)Exercise all other powers necessary for the proper discharge of its functions.
