SEWERAGE/N O WATER BD: Provides relative to the sewerage and water board of New
Orleans
AN ACT1
To amend and reenact R.S. 33:4071(A) and to repeal R.S. 33:4072, relative to Orleans2
Parish; to provide relative to the public water system, the public sewerage system,3
and the public drainage system of the city; to provide relative to the governance of4
such systems; to provide relative to the sewerage and water board of New Orleans5
to change the membership of the board; to provide relative to the terms and removal6
of board members; and to provide for related matters.7
Notice of intention to introduce this Act has been published8
as provided by Article III, Section 13 of the Constitution of9
Louisiana.10
Be it enacted by the Legislature of Louisiana:11
Section 1.  R.S. 33:4071(A) is hereby amended and reenacted to read as follows:12
ยง4071.  Creation and organization of sewerage and water board13
A.(1)  The public water system, the public sewerage system, and the public14
drainage system of the city of New Orleans shall be constructed, controlled,15
maintained, and operated by a sewerage and water board to be composed as follows:16
(a)  The mayor;17
(b)  The two at large members of the council;18

(d) Two members of the board of liquidation, city debt, to be appointed by1
the mayor on the recommendation of the board of liquidation, city debt; and2
(e) Seven citizens, to be appointed by the mayor, with the advice and consent3
of the city council, as follows:4
(i)  Two from the city at large; and5
(ii)  One from each of the five councilmanic districts of the city.6
(2) The terms of office of board members shall be nine years.  	However, the7
citizens who are members of the board on July 31, 1984, shall retain their8
membership until the expiration of their terms unless sooner vacated by resignation9
or otherwise.10

Section 2.  R.S. 33:4072 is hereby repealed in its entirety.12
Section 3. Notwithstanding any other provision of law to the contrary, the additional13
district councilman selected to serve pursuant to R.S. 33:4071(A)(1)(c) as amended by this14
Act shall serve for a term of nine years.15
Section 4. This Act shall become effective upon signature by the governor or, if not16
signed by the governor, upon expiration of the time for bills to become law without signature17
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If18
vetoed by the governor and subsequently approved by the legislature, this Act shall become19
effective on the day following such approval.20

Abstract: Relative to the sewerage and water board of New Orleans, changes the
membership of the board and provides for terms of board members.
Present law (R.S. 33:4071) establishes the sewerage and water board of the city of New
Orleans.  Provides for the composition of the board as follows:
(1)The mayor.

(3)One district councilman selected by the council.
(4)Two members of the board of liquidation, city debt.
(5)Seven citizens, appointed by the mayor, two at large and five from council districts.
Proposed law adds a member to the board by providing that two district councilmen rather
than one district councilman shall serve on the board.  Proposed law otherwise retains the
membership of the board.
Present law provides that terms of board members shall be nine years.
Present law retains present law and provides that the additional district councilman selected
to serve pursuant to proposed law shall serve a nine-year term.
Present law provides that members of the board shall be removed from office only in the
manner and for causes enumerated in Article IX of the Const. of La.
Proposed law removes present law.
Effective upon signature of governor or lapse of time for gubernatorial action.
