Regular Session, 2010 HOUSE BILL NO. 712 BY REPRESENTATIVES WOOTON AND HUTTER FISHING/OYSTERS: Provides for certain restrictions on the taking of oysters AN ACT1 To amend and reenact R.S. 56:434(G) and to enact R.S.56:434(H), relative to taking of seed2 oysters from the public seed grounds; to provide for certain restrictions; and to3 provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 56:434(G) is hereby amended and reenacted and R.S.56:434(H) is6 hereby enacted to read as follows:7 ยง434. Oyster seed grounds; designation and setting aside; rules and regulations8 concerning taking of seed oysters; areas recognized as oyster seed9 reservations; protection of oyster seed reservations 10 * * *11 G. During that portion of the oyster season set aside for the taking of seed12 oysters only, additional restrictions shall apply to harvest of seed oysters from the13 public seed grounds as follows:14 (1) No oyster harvester who is actively harvesting oysters in the public seed15 grounds shall have on board his vessel any sacks or containers which may be used16 to hold oysters for transport to market.17 (2) All oysters on board a vessel actively harvesting oysters in the public18 seed grounds shall be presumed to have been harvested from the public seed19 grounds.20 HLS 10RS-277 ENGROSSED HB NO. 712 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (3) No harvester shall sell, or transport with his vessel, oysters intended for1 market sales on the same day that he harvested seed oysters from the public seed2 grounds.3 H. Proposed law provides that during the seed only portion of oysters season on the public seed grounds that the following restrictions apply: (1)No harvester actively harvesting in the public seed grounds shall have containers on his vessel that can be used to hold oysters for transport to market. (2)All oysters found on a vessel actively harvesting oysters shall be presumed to be harvested from the public seed grounds. (3)No harvester can sell or transport to market oysters intended for market sales on the same day as he harvests from the public seed grounds.
