HOUSE BILL NO. 719
BY REPRESENTATIVE RICHMOND
DISTRICTS/NEIGHBORHOOD:  Authorizes the board of commissioners of certain
neighborhood districts to combine the funds of their respective districts through a
cooperative endeavor agreement
AN ACT1
To enact Part IV of Chapter 29 of Title 33 of the Louisiana Revised Statutes of 1950, to be2
comprised of R.S. 33:9098.1, relative to neighborhood districts; to provide relative3
to district funds; to authorize the governing board of certain districts to combine the4
funds of their respective districts pursuant to a cooperative endeavor agreement,5
subject to limitations; to require the prior approval of members of the homeowners6
association located within each such district; to provide for the use of the combined7
funds; and to provide for related matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1. Part IV of Chapter 29 of Title 33 of the Louisiana Revised Statutes of10
1950, comprised of R.S. 33:9098.1, is hereby enacted to read as follows: 11

ยง9098.1.  District funds; cooperative endeavor agreement13
A. Notwithstanding any other provision of law to the contrary, the board of14
commissioners of any district created pursuant to this Chapter may, through a15
cooperative endeavor agreement, combine the funds of the district with the funds of16
one or more districts created pursuant to this Chapter; however, the board of17
commissioners of any such district shall not combine its funds with the funds of a18

combined funds may be used for any of the stated purposes of any district that is a1
party to the cooperative endeavor agreement.2
B. Prior to the board of commissioners taking any action to combine the3
funds of a district with the funds of another district as authorized in Subsection A of4
this Section, any such action shall be approved by a majority of the members of the5
homeowners association of each such district who are present and voting at a6
meeting of the association.7
Section 2. This Act shall become effective on July 1, 2010; if vetoed by the governor8
and subsequently approved by the legislature, this Act shall become effective on July 1,9
2010, or on the day following such approval by the legislature, whichever is later.10

Abstract: Authorizes the board of commissioners of certain neighborhood districts to
combine their respective funds pursuant to a cooperative endeavor agreement,
subject to limitations.  Provides for the use of such funds.
Present law creates and provides for neighborhood improvement districts in the parishes of
East Baton Rouge, Jefferson, and Orleans. Provides that such districts are created for
various purposes, including to promote and encourage security in the area included within
the districts and to promote and encourage the beautification and overall betterment of the
districts.  Provides that the districts shall be governed by a board of commissioners
consisting of a specified number of members.  Provides for district boundaries.
Present law authorizes the governing authority of the city of New Orleans to levy and
collect, subject to voter approval, various amounts of taxes and fees within the geographical
boundaries of each district. Authorizes the board of commissioners of each district to use
the funds collected by the governing authority of the city for district purposes.
Proposed law retains present law.
Present law requires the board of commissioners of each district to use district funds within
the geographical boundaries of the district.
Proposed law instead authorizes the board of commissioners of any district created pursuant
to present law to, through a cooperative endeavor agreement, combine the funds of the
district with the funds of one or more other such districts.  Requires the board of
commissioners to receive the prior approval of the members of the homeowners association
of each district present and voting at a meeting of the association. Prohibits the board of
commissioners of any such district from combining the funds of the district with the funds
