HOUSE BILL NO. 745

AN ACT1
To amend and reenact R.S. 17:66(A)(2) and R.S. 41:727.1(A)(3) and to enact R.S.2
41:727.1(A)(4) and 904; relative to certain school systems in East Baton Rouge3
Parish and Vermilion Parish; to provide for the transfer of certain sixteenth section4
lands between the East Baton Rouge Parish School System and the Central5
Community School System; to provide relative to the geographic boundaries of the6
Central Community School System; to authorize the Vermilion Parish School Board7
to sell certain specified sixteenth section properties; and to provide for related8
matters.9
Notice of intention to introduce this Act has been published10
as provided by Article III, Section 13 of the Constitution of11
Louisiana.12
Be it enacted by the Legislature of Louisiana:13
Section 1.  R.S. 17:66(A)(2) is hereby amended and reenacted to read as follows:14
§66. Central Community School Board and school system; creation; membership;15
qualifications; apportionment; election; powers, duties, and functions; system16

(2)  The geographic boundaries of the school system shall be as follows:20
Commence at a point on the Comite River at the center line of the river and21
its intersection with the center line of Louisiana Highway 64; thence proceed in a22
southerly direction along the center line of the Comite River to its intersection with23
the center line of White Bayou; thence proceed in a northwesterly direction along the24
center line of White Bayou to a point due east of the intersection of Foster Road and25 ENROLLEDHB NO. 745

Green Gate Drive; thence run due west from said point 3500 feet, more or less, along1
a line to its intersection with the center line of Foster Road; thence proceed in a2
southerly direction along the center line of Foster Road to its intersection with the3
center line of Louisiana Highway 408 (Hooper Road); thence proceed in an easterly4
direction along the center line of Louisiana Highway 408 (Hooper Road) ninety feet,5
more or less, to its intersection with an electric power transmission line on the6
western boundary of the Four Seasons Trailer Park; thence proceed in a southerly7
direction along the electric power transmission line and its extension to its8
intersection with the center line of Cypress Bayou; thence proceed in a southeasterly9
direction along the center line of Cypress Bayou to its intersection with the center10
line of the Comite River; thence proceed in a southeasterly direction along the center11
line of the Comite River to its confluence with the center line of the Amite River;12
thence proceed in a northerly direction along the center line of the meanders of the13
Amite River to its confluence with the center line of Sandy Creek; thence proceed14
in a northerly direction along the center line of Sandy Creek to its intersection with15
the center line of Louisiana Highway 37 (Greenwell Springs Road); thence proceed16
in a southwesterly direction along the center line of Louisiana Highway 3717
(Greenwell Springs Road) to its intersection with the center line of Louisiana18
Highway 409 (Liberty Road); thence proceed in a northerly direction along the19
center line of Louisiana Highway 409 (Liberty Road) to its intersection with the20
center line of Louisiana Highway 64 (Greenwell Springs-Port Hudson Road); thence21
continue north along the center line of Louisiana Highway 409 (Liberty Road) a22
distance of 1000 feet to a point; thence proceed from said point northwesterly along23
a line 1000 feet north of and parallel to Louisiana Highway 64 (Greenwell Springs-24
Port Hudson Road) to its intersection with the center line of Saunders Bayou; thence25
run southerly along the center line of Saunders Bayou to its intersection with the26
center line of Louisiana Highway 64 (Greenwell Springs-Port Hudson Road); east27
boundary of Section 16, Township 5 South, Range 2 East; thence proceed along the28
east boundary of Section 16, north a distance of 2200 feet, more or less, to the29

proceed west a distance of 3100 feet, more or less, to the northwest corner of Section1
16; thence, along the west boundary of Section 16, proceed south a distance of 10002
feet, more or less, to a point on the west boundary of Section 16 that is 1000 feet3
north of the center line of Louisiana Highway 64; thence proceed in a northwesterly4
direction along a line 1000 feet north of and parallel to Louisiana Highway 64 to a5
point 500 feet west of Saunders Bayou; thence proceed southerly along a line 5006
feet west of Saunders Bayou to its intersection with the center line of Louisiana7
Highway 64; thence proceed in a westerly direction along the center line of8
Louisiana Highway 64 to its intersection with the center line of the Comite River, the9
point of beginning.10

Section 2.  R.S. 41:904 is hereby enacted to read as follows: 12
§904. East Baton Rouge Parish School Board; Central Community School Board;13
transfer of certain sixteenth section lands14
A. The legislature hereby recognizes that the East Baton Rouge Parish15
School Board and the Central Community School Board entered into a Quitclaim,16
Transfer and Conveyance Deed and Waiver, Release, and Indemnity Agreement17
effective June 25, 2009, and filed and recorded in East Baton Rouge Parish Original:18
167, Bundle: 12186, by which the East Baton Rouge Parish School Board, to the19
extent allowed by law, transferred, conveyed, assigned, quitclaimed, released and20
relinquished to the Central Community School Board any rights, title and interests,21
including but not limited to mineral rights and rights of management, administration,22
custodianship, control, and maintenance, that the East Baton Rouge Parish School23
Board had or may have had in under, and to that portion of sixteenth section land,24
Township 5 South, Range 2 East, through which Louisiana Highway 64 runs, in East25
Baton Rouge Parish commonly referred to as the "Indian Mound Tract".26
B. Notwithstanding any other law to the contrary, the state of Louisiana27
hereby acknowledges, consents to, approves, ratifies and confirms the Quitclaim,28
Transfer and Conveyance Deed and Waiver, Release, and Indemnity Agreement filed29
and recorded in East Baton Rouge Parish Original: 167, Bundle: 12186.  The state30 ENROLLEDHB NO. 745

of Louisiana hereby further transfers, conveys, and assigns to the Central1
Community School Board all of its ownership rights, title and interest, including2
mineral rights, operation, management, administration, custodianship, and control3
of the property described in Subsection A of this Section subject to any servitudes,4
building restrictions, rights of way, mineral servitudes or leases, or any other matters,5
established by law or of record in the records of East Baton Rouge Parish. 6
C. The state of Louisiana hereby acknowledges and confirms that the Central7
Community School Board is and shall be entitled to all income derived from the8
Indian Mound Tract including but not limited to mineral rights and all mineral9
income, except that portion to which the Livingston Parish School Board is entitled.10
To the extent necessary, the state of Louisiana transfers and assigns all right, title and11
interest in and to any and all existing leases including but not limited to mineral12
leases and mineral contracts related to the Indian Mound Tract.13
Section 3. R.S. 41:727.1(A)(3) is hereby amended and reenacted and R.S.14
41:727.1(A)(4) is hereby enacted to read as follows: 15
§727.1.  Vermilion Parish School Board; transfer of certain sixteenth section lands16

(3) The Vermilion Parish School Board may sell, convey, transfer, assign,19
and deliver any interest, excluding mineral rights, the state or the school board has20
or may have to a certain tract or parcel of land containing 5.106 acres situated in the21
northeast quarter of Section Sixteen (16), Township Eleven (11) South, Range Three22
(3) East, Fourth Ward of Vermilion Parish, state of Louisiana, being more23
particularly described as follows:24
Commencing at the northeast corner of Section 16, T11 S - R 3 E, thence25
proceeding S 00< 03' 10" W along the eastern boundary line of Section 16, a distance26
of 159.92 feet to the point of beginning; thence continuing S 00< 03' 10" W along the27
eastern boundary line of Section 16, a distance of 2,483.22 feet to a point; hence28
proceeding S 89< 56' 17" W, a distance of 95.64 feet to a point on the apparent29
eastern right-of-way line of Bella Road; thence proceeding N 00< 15' 57" E along30 ENROLLEDHB NO. 745

said right-of-way line, a distance of 2339.29 feet to a point; thence proceeding N 01<1
58' 35" E along said right-of-way line, a distance of 43.61 feet to a point; thence2
proceeding N 23< 31' 36" E along said right-of-way line, a distance of 38.71 feet to3
a point; thence proceeding N 44< 24' 35" E along said right-of-way line, a distnace4
of 26.42 feet to a point; thence proceeding N 48< 14' 13" E along said right-of-way5
line, a distance of 69.21 feet to the point of beginning; being bounded on the north6
by the apparent south and southeastern right-of-way line of Bella Road, on the south7
by the Vermilion Parish School Board on the east by Loubert G. Trahan and on the8
west by the apparent eastern right-of-way line of Bella Road, all as per plat by9
Richard J. Primeaux, dated June 20, 2007.10
(4) Such transfers shall be executed without an election and notwithstanding11
any provision of this Chapter or of Part II of Chapter 1 of Title 17 to the contrary.12

Section 4. The provisions of this Section and Section 3 of this Act shall14
become effective upon signature by the governor or, if not signed by the governor,15
upon expiration of the time for bills to become law without signature by the16
governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If17
vetoed by the governor and subsequently approved by the legislature, this Section18
and Section 3 of this Act shall become effective on the day following such approval.19
