TRAFFIC:  Revises the definition of "intersection"
AN ACT1
To amend and reenact R.S. 32:1(26), relative to the traffic regulations; to revise the2
definition of "intersection"; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 32:1(26) is hereby amended and reenacted to read as follows:5
ยง1.  Definitions6
When used in this Chapter, the following words and phrases have the7
meaning ascribed to them in this Section, unless the context clearly indicates a8
different meaning:9

(26)  "Intersection" means:  (a) The area embraced within the prolongation11
or connection of the lateral curb lines, or, if none, then the lateral boundary lines of12
the roadways of two highways which join one another at, or approximately at, right13
angles, or the area within which vehicles traveling upon different highways joining14
at any other angle may come in conflict.15
(b)  Where a highway includes two highways thirty feet or more apart, then16
every crossing of each highway of such divided highway by an intersecting highway17
shall be regarded as a separate intersection.  In the event such intersecting highway18
also includes two highways thirty feet or more apart, then every crossing of two19
highways of such highways shall be regarded as a separate intersection.20 HLS 10RS-1239	ENGROSSED

(c) The junction of an alley or driveway with a street or highway shall not1
constitute an intersection unless the roadway or highway at said junction is2
controlled by a traffic control device.3
(d)  In addition  an "intersection" is defined as:4
(i) Where a highway includes a stop line, yield line, or crosswalk that has not5
been designated on the roadway within the median between the separate6
intersections, the two intersections and the roadway median between them shall be7
considered as one intersection;8
(ii) Where a highway with a stop line, yield line, or crosswalk is designated9
on the roadway on the intersection approach, the area within the crosswalk or beyond10
the designated stop line or yield line shall be part of the intersection; and11
(iii) Where a crosswalk is designated on a roadway on the departure from the12
intersection, the intersection shall include the area extending to the far side of such13
crosswalk.14

Section 2. This Act shall become effective upon signature by the governor or, if not16
signed by the governor, upon expiration of the time for bills to become law without signature17
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If18
vetoed by the governor and subsequently approved by the legislature, this Act shall become19
effective on the day following such approval.20

Abstract: Revises the definition of "intersection".
Present law provides that intersection shall have the following meaning:
(1)The area embraced within the lateral curb lines, or, if none, the lateral boundary lines
of the roadways of two highways which join one another at right angles, or the area
within which vehicles travel upon different highways joining at any angle that may

(2)A highway which includes two highways 30 feet or more apart, then every crossing
of each highway of a divided highway by an intersecting highway shall be regarded
as a separate intersection. In the event such intersecting highway also includes two
highways 30 feet or more apart, then every crossing of two highways of such
highways shall be regarded as a separate intersection. 
Present law provides that the junction of an  alley with a street or highway shall not
constitute an intersection.
Proposed law retains present law but adds the junction of a driveway under proposed law
provisions with a street or highway shall not constitute an intersection unless the roadway
or highway at the junction is controlled by a traffic control device.
Proposed law revises the definition of "intersection" as follows:
(1)Where a highway with a stop line, yield line, or crosswalk  that has not been
designated on the roadway within the median between the separate intersections, the
two intersections and the roadway median shall be considered as one intersection.
(2)Where a highway with stop line, yield line, or crosswalk is designated on the
roadway on the intersection approach, the area within the crosswalk or beyond the
designated stop line or yield line shall be part of the intersection.
(3)Where a crosswalk is designated on a roadway on the departure from the
intersection, the intersection shall include the area extending to the far side of such
crosswalk. 
Effective upon signature of governor or lapse of time for gubernatorial action.
