HOUSE BILL NO. 76
BY REPRESENTATIVE FANNIN
AN ACT1
To provide for the establishment and reestablishment of agency ancillary funds, to be2
specifically known as internal service funds, auxiliary accounts, or enterprise funds3
for certain state institutions, officials, and agencies; to provide for appropriation of4
funds; and to regulate the administration of said funds.5
Be it enacted by the Legislature of Louisiana:6
Section 1. There are hereby appropriated the amounts shown below, which shall be7
payable out of the state general fund, to the extent of funds deposited, unless otherwise8
specified, for the establishment and reestablishment of agency ancillary funds which shall9
be specifically known as internal service funds, auxiliary accounts, or enterprise funds. The10
monies in each fund shall be used for working capital in the conduct of business enterprises11
rendering public service, auxiliary service, and interagency service.12
In the conduct of each such business, receipts shall be deposited in the state treasury13
and disbursements made by the state treasurer to the extent of the amount deposited to the14
credit of each ancillary fund, for the Fiscal Year 2010-2011. All funds appropriated herein15
shall be expended in compliance with the public bid laws of the state.16
Section 2.A. Except as otherwise provided by law or as herein otherwise provided,17
any fund equity resulting from prior year operations shall be included as a resource of the18
fund from which the ancillary fund is directly or indirectly derived.19
B. Funds on deposit with the state treasury at the close of the fiscal year are20
authorized to be transferred to each fund respectively, as equity for Fiscal Year 2011-2012.21
All unexpended cash balances as of June 30, 2011, shall be remitted to the state22
treasurer on or before August 14, 2011. However, savings resulting from executive orders23
shall be remitted to the state treasurer for deposit into the state general fund prior to the end24 ENROLLEDHB NO. 76

of the fiscal year. If not reestablished in the subsequent year's Act, the agency must liquidate1
all assets and return all advances no later than August 14, 2011.2
C.(1) The program descriptions contained in this Act are not part of the law and are3
not enacted into law by virtue of their inclusion into this Act.4
(2) Unless explicitly stated otherwise, each of the program objectives and the5
associated performance indicators contained in this Act shall reflect the key performance6
standards to be achieved by the 2010-2011 Fiscal Year.7
Section 3. All money from federal, interagency transfers, statutory dedications, or8
fees and self generated revenues shall be available for expenditure in the amounts herein9
appropriated. 10
Any increase in such revenues shall be available for allotment and expenditure by11
an agency on approval of an increase in the appropriation by the commissioner of12
administration and the Joint Legislative Committee on the Budget. Any increase in such13
revenues for an agency without an appropriation from the respective revenue source shall14
be incorporated into the agency's appropriation on approval of the commissioner of15
administration and the Joint Legislative Committee on the Budget.16
Section 4.A. The figures in parentheses following the designation of a budget entity17
are the total authorized positions for that entity.  The number of employees approved for18
each agency, as a result of the passage of this Act, may be increased by the commissioner19
of administration when sufficient documentation is presented and the request is deemed20
valid. However, any request which exceeds five positions shall be approved by the21
commissioner of administration and the Joint Legislative Committee on the Budget.22
B.  The budget request of any agency with an appropriation level of thirty million23
dollars or more shall include within its existing table of organization positions which24
perform the function of internal auditing.25
Section 5. The following definition is provided for the terms of this Act:  "Working26
Capital" shall be considered the excess of current assets over current liabilities on an accrual27
basis.28
Section 6. Should any section, subsection, clause, sentence, phrase, or part of the Act29
for any reason be held, deemed, or construed to be unconstitutional or invalid, such decisions30
shall not affect the remaining provisions of the Act, and the legislature hereby declares that31 ENROLLEDHB NO. 76

it would have passed the Act, and each section, subsection, clause, sentence, phrase, or part1
thereof, irrespective of the fact that one or more of the sections, subsections, clauses,2
sentences, phrases, or parts thereof, is declared unconstitutional or invalid. To this end, the3
provisions of this Act are hereby declared severable.4
Section 7.  Internal Service Funds. These funds account for the financing of goods5
or services provided by one department or agency to other departments or agencies of the6
governmental unit, or to other governmental units, on a cost-reimbursement basis.  Excess7
cash funds, excluding cash funds arising from working capital advances, shall be invested8
by the state treasurer with the interest proceeds there from credited to each account and shall9
not be transferred to the state general fund.10

Program Description:   Provides for economic utilization and preservation of the4
waters of the Sabine River and its tributaries by promoting economic development,5
irrigation, navigation, improved water supply, drainage, public recreation and6
hydroelectric power for the citizens of Louisiana.7
Objective:   Through the Sabine River Authority activity, to maintain self-8
generated revenues from recreational fees, payments from the Cypress Bend Resort9
and water sales from Toledo Bend Reservoir to at least $1,316,000 in order to10
establish and maintain a reserve fund at $3.5 million by the year 2013. Develop11
water supply as the primary source of revenue in lieu of Hydroelectric Power12
Production by 2018.13

Program Description:   Helps individual citizens and local governments4
participate in environmental programs by assisting municipalities finance and5
construct wastewater treatment works.6
The Municipal Facilities Revolving Fund is used by the Department of7
Environmental Quality to assist recipients of Environmental Protection Agency and8
construction grants in providing project inspection, construction management, and9
overall program management services, required for the completion of the10
Environmental Protection Agency program, as outlined in the management grant.11
Regional meetings are held in the state’s eight planning districts with one-on-one12
follow-up meetings to make municipalities more aware of the program’s benefits13
and requirements.14

Program Description:  Makes low interest loans to local political subdivisions4
(municipalities, water districts for-profit and non-profit water systems) for the5

The Safe Drinking Water Revolving Loan Fund is used by the Department of Health8
and Hospitals/Office of Public Health for assisting public water systems with9
improving their drinking water to meet or maintain Environmental Protection10
Agency Drinking Water standards. This assistance improves Louisiana’s overall11
drinking water quality, thereby improving public health. The impact of this fund is12
part of the improvement to drinking water quality being brought about by the13
various programs in the department shown in the performance levels for this14
department. 15

Section 8. The appropriations and allocations contained in this Section shall be in27
addition to and supplemental to all of the appropriations made in the Act which originated28
as House Bill No. 1 of the 2010 Regular Session of the Legislature, and the appropriations29
and allocations made in this Section shall be deemed to be incorporated into, made a part of,30
and expended in accordance with and in all respects shall be subject to all of the conditions,31
stipulations, and provisions of Sections 1 through 18 of the Act which originated as House32
Bill No. 1 of the 2010 Regular Session of the Legislature. In accordance with the provisions33
of R.S. 39:57.1, the commissioner of administration shall notify each budget unit receiving34
an allocation or appropriation in this Section as to the nature and amount of allocation or35
appropriation contained herein no later than two weeks after the effective date of this Act.36

Provided, however, that of the $366,404,491 appropriated to Schedule 09-306 Medical39
Vendor Payments, the Department of Health and Hospitals may make supplemental40
Medicaid payments for both inpatient and outpatient services using upper payment limit41
(UPL) methodology to private and non-state, non-rural public hospitals. The payments may42
be made up to the private UPL cap. The department may enter into Low income and Needy43
Care Collaborative Agreements to ensure access to health care services for the poor and44
needy.  Provided, further, the Department of Health and Hospitals may lower45
disproportionate share (DSH) payment qualification thresholds to the minimum federally46 ENROLLEDHB NO. 76

mandated criteria to qualify hospitals that are a party to a Low Income and Needy Care1
Collaborative Agreement with the Department of Health and Hospitals. All DSH payments2
shall be limited to hospital-specific uncompensated care costs in accordance with federal law3
and state appropriation. These hospitals shall not be precluded from eligibility for payment4
from other available DSH funding for which they are eligible.  The Department of Health5
and Hospitals shall submit a quarterly report no later than October 1, 2010 to the Joint6
Legislative Committee on the Budget prior to making any expenditures provided for herein7
regarding the historical status of participation in the program and Medicaid payments made8
to participating hospitals to ensure federal UPL and DSH caps are not exceeded.9
Provided, however, notwithstanding the provisions of Schedule 09-306 of Section 18 of the10
Act which originated as House Bill No. 1 of the 2010 Regular Session of the Legislature11
relative to Medicaid upper payment limit payments, disproportionate share hospital12
payments and Low Income and Needy Care Collaborative Agreements, these provisions13
shall supercede any provisions in that Act, and in particular the provisions on page 10, lines14
1 through 18, contained in Amendment No. 81 of the Senate Floor Amendments (as15
designated SFAHB1 GASCONR 5475) proposed by Senator Michot and adopted by the16
Senate on June 18, 2010, which are the same or similar, and such provisions of that Act shall17
be null, void, and of no effect.18
The commissioner of administration is hereby authorized and directed to adjust the means19
of financing contained in Schedule 09-306 Medical Vendor Payments, in the Act which20
originated as House Bill No. 1 of the 2010 Regular Session of the Legislature by reducing21
the appropriation out of the State General Fund (Direct) by $7,000,000 and increasing the22
appropriation out of the State General Fund by Statutory Dedications out of the23
Overcollections Fund by $7,000,000. 24

Section 9. The appropriation contained in this Section shall be in addition to and13
supplemental to all of the appropriations made in the Act which originated as House Bill No.14
1 of the 2010 Regular Session of the Legislature, and the appropriation made in this Section15
shall be deemed to be incorporated into, made a part of, and expended in accordance with16
and in all respects shall be subject to all of the conditions, stipulations, and provisions of17
Sections 19 of the Act which originated as House Bill No. 1 of the 2010 Regular Session of18
the Legislature.19
The sum of Thirty-five Thousand and No/100 ($35,000.00) Dollars to Jackie Redmon20
and Adel Carrera is hereby appropriated out of the General Fund of the state of Louisiana21
for Fiscal Year 2010-2011 to be used to pay the consent judgment in the suit entitled "Jackie22
Redmon and Adel Carrera v. Kenneth Jeansonne, et al", bearing Number 20089-2035 "B",23
on the docket of the Twelfth Judicial District Court, parish of Avoyelles, state of Louisiana.24
Section 10. This Act shall become effective on July 1, 2010; if vetoed by the governor25
and subsequently approved by the legislature, this Act shall become effective on July 1,26
2010, or on the day following such approval by the legislature, whichever is later.27
