PETROLEUM/OIL-GAS: Authorizes the use of alternative refrigerants in mobile air
conditioning systems
AN ACT1
To amend and reenact R.S. 40:1846(B)(3)(f), relative to refrigerants; to authorize the use of2
a safe alternative to liquefied petroleum gas in motor vehicle air conditioning3
systems; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 40:1846(B)(3)(f) is hereby amended and reenacted to read as6
follows:7
ยง1846. Rules and regulations of commission; exceptions; reporting; data sharing;8
permit requirements; penalties; liability; state of emergency or disaster9

B. In adopting rules and regulations, the commission shall be governed by11
the following provisions:12

(3)  The rules and regulations shall provide that a dealer shall not serve any14
liquefied petroleum gas system which the dealer knows is improperly installed or in15
a dangerous condition.  The rules and regulations shall require the following16
provisions relative to liquefied petroleum gas systems:17

(f) No person, firm, or corporation shall use, sell, or distribute liquefied1
petroleum gas for use in mobile air conditioning systems	; however, the prohibition2
shall not apply to a refrigerant included on the list published by the Environmental3
Protection Agency as a safe, alternative motor vehicle air conditioning substitute for4
chlorofluorocarbon-12, pursuant to 42 U.S.C. 7671k(c). For purposes of this5
Subparagraph "mobile air conditioning system" means mechanized vapor6
compression equipment which is used to cool the driver's or passenger's7
compartment of any motor vehicle.  So that it may be determined whether the8
refrigerant is a liquefied petroleum gas, the proper shipping name shall be used on9
any product intended for use as a refrigerant in a mobile air conditioning system.10
Proper shipping names with a U.N. number and a hazard class and division number11
of liquefied petroleum gas per the U.S. United States Department of Transportation12
hazardous materials tables shall be prima facie evidence that the refrigerant is13
liquefied petroleum gas and is prohibited.  Any advertising or other literature14
published by the manufacturer of the refrigerant promoting it as a replacement or15
drop-in for CFR-12 or HFC 134a, or both, shall be prima facie evidence that it is16
being sold for mobile air conditioning systems.17

Abstract: Authorizes the use of a safe alternative to liquefied petroleum gas in motor
vehicle air conditioning systems.
Present law prohibits the use of liquefied petroleum gas in mobile air conditioning systems.
Proposed law authorizes the use of an alternative refrigerant listed on the EPA list as a safe
alternative to chlorofluorocarbon-12.
(Amends R.S. 40:1846(B)(3)(f))
