HOUSE BILL NO. 862

TRANSPORTATION DEPT:  Authorizes DOTD to convey surplus property to the city of
Lafayette
AN ACT1
To authorize and provide for the transfer or lease of certain state property in Lafayette Parish2
to the Lafayette Parish Consolidated Government from the Department of3
Transportation and Development and division of administration; and to provide for4
related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. The secretary of the Department of Transportation and Development and7
commissioner of division of administration are hereby authorized, for and on behalf of the8
state of Louisiana, to convey, transfer, assign, sell, and deliver all right, title, and interest the9
state may have in certain improvements, particularly the house locally known as the Khoury10
House, situated on SPN: 455-01-0034 Parcel No. ADV-18-P-1, located in Lafayette Parish11
to the Lafayette Parish Consolidated Government, said improvements are situated wholly12
or partially upon, a certain tract of land designated as:13
PARCEL ADV-18-P114
Those three (3) certain lots of ground situated in McComb Addition in the City of15
Lafayette, Louisiana, together with all buildings and improvements thereon, and16
according to a plat of survey of said addition on file in the Office of the Clerk of17
Court in and for the Parish of Lafayette, Louisiana, are known and designated as lots18
18, 19, and 20 of Block 4, of said addition; said lots having uniform width of 25' and19
a depth in parallel lines of 125'; said lots are bounded northerly by Third Street,20
easterly by Chestnut Street, southerly by Lots Nos. 15, 16, and 17 of said Block 421
and westerly by Lot 21 of said Block 4.  Being the same property acquired by22
mortgagor by Act No. 583241 of the Records of Lafayette Parish. 23
Being all of vendor's property acquired by act recorded 11/16/05, in at file24

Section 2. The secretary of Department of Transportation and Development and1
commissioner of division of administration, on behalf of the state of Louisiana, are hereby2
authorized to enter into such agreements, covenants, conditions, and stipulations and to3
execute such documents as are necessary to properly effectuate any conveyance, transfer,4
assignment, lease, or delivery of the improvements, located on the property described in5
Section 1 herein, and as more specifically described in any such agreements entered into and6
documents executed by and between the secretary of Department of Transportation and7
Development and commissioner of division of administration and the Lafayette Parish8
Consolidated Government, in exchange of consideration proportionate to the market value9
of said improvements.10
Section 3. This Act shall become effective upon signature by the governor or, if not11
signed by the governor, upon expiration of the time for bills to become law without signature12
by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana.  If13
vetoed by the governor and subsequently approved by the legislature, this Act shall become14
effective on the day following such approval.15
