Regular Session, 2010 HOUSE BILL NO. 872 BY REPRESENTATIVE MILLS PHARMACISTS: Allows pharmacists to administer influenza immunizations AN ACT1 To enact R.S. 37:1218, relative to the administration of influenza immunizations; to provide2 for allowable pharmacist services; to provide for conditions under which pharmacists3 may administer influenza immunizations; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 37:1218 is hereby enacted to read as follows: 6 ยง1218. Administration of influenza immunization7 A pharmacist may administer an influenza immunization to any person seven8 years of age or older without a prescription or medical order contingent upon all of9 the following provisions:10 (1) The pharmacist shall administer influenza immunizations in conformance11 with the most current annual influenza vaccination administration protocol as set12 forth by the United States Centers for Disease Control and Prevention (CDC)13 Advisory Committee on Immunization Practice (ACIP).14 (2) The pharmacist shall report each influenza immunization to the Louisiana15 Office of Public Health Immunization Registry at the time of the immunization or16 as soon as reasonably practicable thereafter.17 (3) The pharmacist shall report all adverse events he observes or which are18 reported to him to the Vaccine Adverse Events Reporting System (VAERS), the19 HLS 10RS-1280 ORIGINAL HB NO. 872 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. cooperative program of the CDC and the United States Food and Drug1 Administration for vaccine safety, or its successor program.2 (4) The pharmacist shall maintain for at least two years a record of each3 influenza immunization administered.4 (5) The pharmacist shall obtain the appropriate credential to administer5 influenza immunizations from the board, as administratively defined, prior to6 administering any such immunization.7 DIGEST The digest printed below was prepared by House Legislative Services. Proposed law allows pharmacists to administer influenza immunizations to persons age seven and up if immunizations are: performed according to U.S. Centers for Disease Control guidelines; reported to the state registry for immunizations; and recorded by the pharmacist with the record maintained for two years. Proposed law requires pharmacists to report all adverse effects observed to the appropriate authority (Vaccine Adverse Events Reporting System - VAERS). Proposed law provides that only pharmacists with the appropriate credential from the Louisiana Board of Pharmacy to administer influenza immunizations may do so. (Adds R.S. 37:1218)
