WILDLIFE & FISHERIES SEC: Allows the secretary of the Dept. of Wildlife and Fisheries
to close an area to limit the spread of disease
AN ACT1
To amend and reenact R.S. 56:6.1(A), relative to emergency closure of hunting or fishing2
seasons; to provide for the limiting of disease; to restrict the feeding or baiting of3
wildlife; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 56:6.1(A) is hereby amended and reenacted to read as follows:6
ยง6.1.  Emergency closure of hunting or fishing seasons; rules and regulations;7
prohibitions; penalties8
A. The secretary, in an emergency 	or for the purpose of limiting or9
preventing the spread of disease, may close an area to the hunting or taking of10
wildlife or may restrict the hunting or, taking, feeding, or baiting of wildlife in a11
designated area in any manner deemed advisable. In addition, in an emergency, the12
secretary may declare a closed season on any or all species of fish found or existing13
in the waters of the state or may restrict fishing in the closed season in any manner14
deemed advisable.  Such closure shall be for a period of time not to extend beyond15
the seventh day following the next meeting of the commission.16

Abstract: Authorizes the secretary of the Dept. of Wildlife and Fisheries to close an area
to hunting, baiting, or feeding to limit the spread of disease.
Present law authorizes the secretary, in an emergency, to close an area to hunting or declare
a closed season on any species of fish or to otherwise restrict hunting or fishing. Provides
that any such closure shall be made through issuance of an emergency rule under the
Administrative Procedure Act, which must include a description of the area closed and the
restrictions applied. Limits the duration of the closure period to not more than seven days
after the next meeting of the commission.
Proposed law retains present law and includes limiting or preventing the spread of disease
as a basis to close or restrict hunting in an area.  Additionally, in such areas, feeding or
baiting may be closed or restricted.
