GAUTREAUX WILDLIFE & FISHERIES DEP: Authorizes the issuance of a restricted hunter education certificate for developmentally disabled hunters AN ACT1 To amend and reenact R.S. 56:699.5, relative to hunter education; to provide for exceptions2 to the requirement for hunter education; and to provide for related matters.3 Be it enacted by the Legislature of Louisiana:4 Section 1. R.S. 56:699.5 is hereby amended and reenacted to read as follows:5 ยง699.5. Firearm and hunter education requirement6 A. No person shall hunt with a firearm unless that person has first been7 issued a certificate of satisfactory completion of a firearm and hunter education8 course taught or approved by the department, or possesses a valid hunting license9 issued by the department. However, a person under sixteen years of age may hunt10 without such certificate if he is accompanied by and is under the direct supervision11 of a person who is eighteen years of age or older and has a valid hunting license or12 proof of successful completion of a hunter safety education course approved by the13 department.14 B. Documentation of the developmental disability from1 a licensed medical doctor shall be presented prior to the issuance of a restricted2 hunter education certificate.3 C. For the purposes of this Subsection Section, "direct supervision" means4 that the person being supervised shall be within a normal audible voice proximity5 and in direct line of sight of the supervising adult at all times while hunting.6 B. D. The commission may adopt rules to implement the provisions of this7 Section, including rules to define the circumstances that constitute a person being8 accompanied by and under the direct supervision of another.9 DIGEST The digest printed below was prepared by House Legislative Services. Present law prohibits any person from hunting without either completing a firearm and hunter education course taught or approved by Dept. of Wildlife and Fisheries or possessing a valid hunting license. Excepts from this prohibition a person under 16 who is hunting under the direct supervision of a person who is at least 18 and who has a valid hunting license or who has passed the hunter safety education course. Present law defines "direct supervision" to mean the person being supervised is within a normal audible voice proximity and in the direct line of sight of the supervising adult at all times while hunting. Proposed law retains present law and authorizes the issuance of a restricted hunter education certificate to a developmentally disabled person who is unable to successfully complete a hunter safety course. Such permit allows a person to hunt if he is accompanied by and is under the direct supervision of a person who is 18 years of age or older and has a valid hunting license or proof of successful completion of a hunter safety education course. Proposed law requires documentation of the developmental disability prior to the issuance of a restricted hunter education certificate. (Amends R.S. 56:699.5)
