ENVIRONMENT/PERMITS:  Provides for the authority to issue notifications of inclusion
for certain permits
AN ACT1
To amend and reenact R.S. 30:2011(D)(3), 2014(A)(1), and 2054(B)(2)(a), relative to the2
authority to issue a regulatory permit; to provide for the authority of the secretary of3
the Department of Environmental Quality; to provide for the authority to issue a4
regulatory permit; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 30:2011(D)(3), 2014(A)(1), and 2054(B)(2)(a) are hereby amended7
and reenacted to read as follows: 8
§2011.  Department of Environmental Quality created; duties; powers; structure9

D.  The secretary shall have the following powers and duties:11

(3) To delegate the power to grant or deny permits, licenses, registrations,13
variances, or compliance schedules to the appropriate assistant secretary.  The14
authority to execute minor permit actions and to issue registrations, certifications,15
notices of deficiency, and notification of inclusion under a general permit or16
regulatory permit may be delegated by the secretary or the appropriate assistant17
secretary to an authorized representative, notwithstanding the provisions of R.S.18
30:2050.26.19

§2014.  Permits, licenses, registrations, variances, and monitoring fees1
A.(1) All permits, licenses, registrations, variances, and compliance2
schedules authorized by this Subtitle shall be granted by the secretary.  The power3
to grant or deny permits, licenses, registrations, variances, or compliance schedules4
may be delegated by the secretary to the appropriate assistant secretary, subject to5
his continuing oversight. The authority to execute minor permit actions and to issue6
registrations, certifications, notices of deficiency, and notification of inclusion under7
a general permit or a regulatory permit may be delegated by the secretary or the8
appropriate assistant secretary to an authorized representative, notwithstanding the9
provisions of R.S. 30:2050.26.10

§2054.  Air quality control; secretary of environmental quality; powers and duties12

B.  The secretary shall have the following powers and duties:14

(2)(a) To develop permitting procedures and regulations conforming to16
applicable state and federal laws, and to require and issue permits, licenses,17
variances, or compliance schedules for all sources of air contaminants within the18
state of Louisiana and when the secretary deems it advisable to delegate the power19
to issue or deny such permits, licenses, variances, or compliance schedules to the20
appropriate assistant secretary subject to his continuing oversight. The authority to21
execute minor permit actions, to issue registrations, certifications, notices of22
deficiency, and notification of inclusion under a general permit or a regulatory23
permit may be delegated by the secretary or the appropriate assistant secretary to an24
authorized representative, notwithstanding the provisions of R.S. 30:2050.26.25

Abstract: Allows the delegation to a representative of the authority of the secretary or
assistant secretary of the Dept. of Environmental Quality to issue regulatory permits.
Present law authorizes the delegation of the authority of the secretary or assistant secretary
of the Dept. of Environmental Quality to execute minor permit actions to representative.
Proposed law retains present law and adds the delegation, to a representative, of the authority
to issue regulatory permits.
