PROPERTY/ABANDONED:  Provides relative to abandoned and blighted housing property
donated to or purchased by a nonprofit organization
AN ACT1
To amend and reenact R.S. 33:4717.3 and to enact R.S. 33:4717.4, relative to abandoned and2
blighted property; to provide relative to the donation and public sale of such property3
by municipalities and parishes; to provide relative to the donation and public sale of4
any such property to nonprofit organizations; to require nonprofit organizations to5
renovate any such property within one year of sale or donation; to provide relative6
to the preparation and approval of renovation plans; and to provide for related7
matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1. R.S. 33:4717.3 is hereby amended and reenacted and R.S. 33:4717.4 is10
hereby enacted to read as follows:11
§4717.3.  Donation of abandoned or blighted property; municipality municipalities12
and parishes; nonprofit organizations13
A. The governing authority of a municipality or parish may donate any14
abandoned or blighted housing properties owned by the municipality or parish to any15
nonprofit organization which is recognized by the Internal Revenue Service as a16
501(c)(3) or 501(c)(4) nonprofit organization and which agrees to renovate and17
maintain such property until conveyance of the property by such organization.18
B. Any such nonprofit organization shall complete all renovations to the19

renovated in accordance with a renovation plan that is submitted to and approved by1
the governing authority of the municipality or parish prior to the date of donation.2
§4717.4.  Tax sale; abandoned or blighted property; nonprofit organizations3
Any nonprofit organization which is recognized by the Internal Revenue4
Service as a 501(c)(3) or 501(c)(4) nonprofit organization that purchases, at a public5
sale, abandoned or blighted housing property that has been adjudicated to a6
municipality or parish, shall complete all renovations to the purchased property7
within one year from the date of sale. The governing authority of the municipality8
or parish shall provide, by ordinance, that the approval of the sale of such property9
to any such organization shall be conditioned on the approval of a renovation plan10
submitted to the municipality or parish by any such organization. The property shall11
be renovated in accordance with any such renovation plan.12
Section 2. This Act shall become effective upon signature by the governor or, if not13
signed by the governor, upon expiration of the time for bills to become law without signature14
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If15
vetoed by the governor and subsequently approved by the legislature, this Act shall become16
effective on the day following such approval.17

Abstract: Relative to abandoned and blighted housing property, requires nonprofit
organizations to renovate any such donated or purchased property within one year
from the date of donation or purchase.
Present law authorizes the governing authority of a municipality or parish to donate any
abandoned or blighted housing properties owned by the parish to any nonprofit organization
which is recognized by the IRS as a 501(c)(3) or 501(c)(4) nonprofit organization and which
agrees to renovate and maintain such property until conveyance of the property by such
organization.  Proposed law retains present law and clarifies that the governing authority of
a municipality may donate any such property it owns to a nonprofit organization.  
Proposed law requires nonprofit organizations to complete all renovations to the property
donated by the municipality or parish within one year from the date of donation.

that is submitted to and approved by the governing authority of the municipality or parish

Proposed law requires any nonprofit organization that purchases, at a public sale, abandoned
