Regular Session, 2010 HOUSE BILL NO. 994 BY REPRESENTATIVE HARRISON STUDENT/LOANS-SCHOLARSHP: Relative to TOPS, provides, under specified circumstances, for the repayment by a student of an award amount paid on his behalf by the state during the first two award years AN ACT1 To enact R.S. 17:3048.1(C)(6), relative to the Taylor Opportunity Program for Students; to2 provide for program eligibility, including under specified circumstances, for the3 repayment by a student of an award amount that is paid on his behalf during the first4 two award years; to provide conditions and limitations; to provide effectiveness; to5 provide an effective date; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 17:3048.1(C)(6) is hereby enacted to read as follows: 8 ยง3048.1. Program awards; eligibility; amounts; limitations; funding; administration9 * * *10 C.11 * * *12 (6)(a) Notwithstanding any provision of this Chapter to the contrary and in13 addition to any other eligibility requirements provided by this Section for a student14 to initially receive and to continue to receive a program award, for a student to be15 eligible to have an award payment made on his behalf by the administering agency16 to an eligible institution, the student on whose behalf an award payment is made for17 any particular semester or other applicable time period during the first two award18 years shall agree to and be required to repay to the administering agency such award19 HLS 10RS-1432 ORIGINAL HB NO. 994 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. amount upon a determination by the agency that the student, during that particular1 semester or other applicable time period, failed to meet any of the requirements2 provided by Paragraph (A)(4) of this Section as may be applicable relative to the3 student making steady academic progress or maintaining full-time standing for4 continuing in the program.5 (b) The provisions of this Paragraph shall be applicable to those students6 who first qualify for a program award for the 2011-2012 award year or for any award7 year thereafter.8 * * *9 Section 2. This Act shall become effective upon signature by the governor or, if not10 signed by the governor, upon expiration of the time for bills to become law without signature11 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Applies to those students who first qualify for a program award for the 2011-2012 award year and any award year thereafter. Proposed law, relative to the Taylor Opportunity Program for Students, provides (notwithstanding any provision of present law to the contrary and in addition to any other eligibility requirements provided by present law for a student to initially receive and to continue to receive a program award) that for a student to be eligible to have an award payment during the first two award years, the student, for any particular semester or other applicable time period, shall agree to and be required to repay such award amount upon a determination by the agency that the student, during that particular semester or other applicable time period, failed to meet any of the requirements provided by present law (as may be applicable) relative to making steady academic progress or maintaining full-time standing for continuing in the program. Provides that proposed law provisions are applicable to those students who first qualify for a program award for the 2011-2012 award year and any award year thereafter.
