HLS 10RS-1006 ENGROSSED Page 1 of 3 Regular Session, 2010 HOUSE CONCURRENT RESOLUTI ON NO. 87 BY REPRESENTATIVES HARDY AND RICHMOND CRIMINAL/BUREAU CRIML ID: Provides with respect to racial profiling A CONCURRENT RESOLUTI ON1 To create a task force to study the feasibility of requiring law enforcement agencies to2 record data and report statistics to the Department of Public Safety and Corrections3 regarding the total number of persons stopped for traffic violations, the race of each4 person stopped, and the action taken pursuant to each stop, and to report its findings5 and recommendations to the House Committee on Judiciary, the president of the6 Senate, and the speaker of the House of Representatives prior to January 1, 2012.7 WHEREAS, the Louisiana Bureau of Criminal Identification and Information was8 established within the Department of Public Safety and Corrections to timely collect,9 process, and disseminate available information on crime, offenders, and the operations of10 the criminal justice system through a centralized system; and11 WHEREAS, the Louisiana Commission on Law Enforcement and the Administration12 of Criminal Justice, established as the central coordinating agency for adult and juvenile13 correctional systems, works in conjunction with the Department of Public Safety and14 Corrections to maintain accurate and timely statistical information relative to the operation15 of state and local correctional systems; and16 WHEREAS, the Integrated Criminal Justice Information System Policy Board was17 established for the purpose of assisting the agencies involved in the operations of the18 individual systems by facilitating the development of the Integrated Criminal Justice19 Information System, to provide for common standards to ensure communication among20 HLS 10RS-1006 ENGROSSED HCR NO. 87 Page 2 of 3 systems, and to provide a common forum for the discussion of issues affecting the agencies1 involved; and 2 WHEREAS, these systems may also be utilized in the collection of traffic data; and3 WHEREAS, this legislature has enacted policy against racial profiling including the4 provisions of R.S. 32:398.10 which provides for the collection and reporting of statistical5 information relating to traffic stops; and6 WHEREAS, there is some concern that traffic data is not being properly7 disseminated and that racial profiling continues to exist; and8 WHEREAS, according to a 2009 report issued by the American Civil Liberties Union9 and the Rights Working Group, evidence of racial profiling does exist in Louisiana.10 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby11 create a task force to study the feasibility of requiring law enforcement agencies to record12 data and report statistics to the Department of Public Safety and Corrections regarding the13 total number of persons stopped for traffic violations, the race of each person stopped, and14 the action taken pursuant to each stop, and to make recommendations to this legislature.15 BE IT FURTHER RESOLVED that the task force shall be composed of the16 following members:17 (1) One member designated by the Louisiana Sheriffs' Association.18 (2) One member designated by the Louisiana Association of Chiefs of Police.19 (3) One member designated by the Louisiana Municipal Association.20 (4) One member designated by the Louisiana State Police.21 (5) One member designated by the Louisiana Department of Public Safety and22 Corrections.23 (6) One member designated by the American Civil Liberties Union of Louisiana.24 (7) One member designated by the National Association for the Advancement of25 Colored People.26 (8) One member designated by the Southern Poverty Law Center.27 (9) One member designated by Louisiana Catholic Charities.28 (10) One member designated by the Louisiana Public Defender Board.29 (11) One member designated by the Louisiana Legislative Black Caucus. 30 HLS 10RS-1006 ENGROSSED HCR NO. 87 Page 3 of 3 (12) One member designated by the Louisiana attorney general.1 BE IT FURTHER RESOLVED that the task force shall hold its organizational2 meeting within sixty days after the adoption of this Resolution.3 BE IT FURTHER RESOLVED that the task force shall elect a chairman, who shall4 be responsible for calling subsequent meetings, and a vice chairman, at its organizational5 meeting.6 BE IT FURTHER RESOLVED that the task force shall complete its study and7 submit the report of its findings and recommendations to the House Committee on Judiciary,8 the president of the Senate, and the speaker of the House of Representatives prior to January9 1, 2012.10 DIGEST The digest printed below was prepared by House Legislative Services.
