HOUSE RESOLUTION NO. 126

LEGISLATIVE AFFAIRS: Requests the House Executive Committee to direct House
Legislative Services staff to study population range provisions in the La. Constitution
and in the Revised Statutes
A RESOLUTION1
To request the House Executive Committee to direct House Legislative Services staff to2
study population range provisions in the Constitution of Louisiana and in the3
Louisiana Revised Statutes of 1950 and to report their findings to the House of4
Representatives prior to the convening of the 2011 Regular Session of the5
Legislature.6
WHEREAS, there exists in the Constitution of Louisiana and in the Louisiana7
Revised Statutes of 1950 many provisions of law which are narrowly tailored by population8
margins based on federal decennial census figures to affect certain classes of municipalities9
or parishes; and10
WHEREAS, with the release of the 2010 federal census data, drastically changed11
population totals around the state could render inapplicable many important provisions of12
law originally and specifically enacted for certain classes of local governmental13
subdivisions; and14
WHEREAS, the latest federal decennial census figures may have a dramatic and15
upending effect on past and future policy decisions of the legislature by altering the16
applicability of various provisions of law; and17
WHEREAS, these population range provisions should be identified prior to the next18
legislative session and amended in that session in order to ensure the constancy of legislative19
policy determinations after the latest federal decennial census results become effective.20 HLS 10RS-4568	ORIGINAL

THEREFORE, BE IT RESOLVED that the House of Representatives of the1
Legislature of Louisiana does hereby request the House Executive Committee to direct2
House Legislative Services staff to study population range provisions in the state constitution3
and in the revised statutes and to report their findings to the House of Representatives prior4
to the convening of the 2011 Regular Session of the Legislature.5
