HOUSE RESOLUTION NO. 126

LEGISLATIVE AFFAIRS: Requests the House Executive Committee to direct House
Legislative Services staff to study population range provisions and provisions based
on the number of congressional districts in the state in the La. Constitution and in the
Revised Statutes
A RESOLUTION1
To request the House Executive Committee to direct House Legislative Services staff to2
study population range provisions and provisions based on the number of3
congressional districts in the state in the Constitution of Louisiana and in the4
Louisiana Revised Statutes of 1950 and to report their findings to the House of5
Representatives prior to the convening of the 2011 Regular Session of the6
Legislature.7
WHEREAS, there exist in the Constitution of Louisiana and in the Louisiana Revised8
Statutes of 1950 many provisions of law which are narrowly tailored by population margins9
based on federal decennial census figures to affect certain classes of municipalities or10
parishes; and11
WHEREAS, with the release of the 2010 federal census data, drastically changed12
population totals around the state could render inapplicable many important provisions of13
law originally and specifically enacted for certain classes of local governmental14
subdivisions; and15
WHEREAS, there exist in the state constitution and the revised statutes many16
provisions of law that are based on the number of congressional districts in the state; and17
WHEREAS, the number of seats in the U.S. House of Representatives that are18
allocated to the state is likely to change based on the results of the census currently being19
conducted, thereby changing the number of congressional districts in the state; and20 HLS 10RS-4568	ENGROSSED

WHEREAS, the latest federal decennial census figures may have a dramatic and1
upending effect on past and future policy decisions of the legislature by altering the2
applicability of various provisions of law; and3
WHEREAS, these population range provisions and provisions based on the number4
of congressional districts in the state should be identified prior to the next legislative session5
and amended in that session in order to ensure the constancy of legislative policy6
determinations after the latest federal decennial census results become effective.7
THEREFORE, BE IT RESOLVED that the House of Representatives of the8
Legislature of Louisiana does hereby request the House Executive Committee to direct9
House Legislative Services staff to study population range provisions and provisions based10
on the number of congressional districts in the state in the state constitution and in the11
revised statutes and to report their findings to the House of Representatives prior to the12
convening of the 2011 Regular Session of the Legislature.13
