ENROLLED Page 1 of 2 Regular Session, 2010 HOUSE RESOLUTION NO. 126 BY REPRESENTATIVE LEGER A RESOLUTION To request the House Executive Committee to direct House Legislative Services staff to study population range provisions and provisions based on the number of congressional districts in the state in the Constitution of Louisiana and in the Louisiana Revised Statutes of 1950 and to report their findings to the House of Representatives prior to the convening of the 2011 Regular Session of the Legislature. WHEREAS, there exist in the Constitution of Louisiana and in the Louisiana Revised Statutes of 1950 many provisions of law which are narrowly tailored by population margins based on federal decennial census figures to affect certain classes of municipalities or parishes; and WHEREAS, with the release of the 2010 federal census data, drastically changed population totals around the state could render inapplicable many important provisions of law originally and specifically enacted for certain classes of local governmental subdivisions; and WHEREAS, there exist in the state constitution and the revised statutes many provisions of law that are based on the number of congressional districts in the state; and WHEREAS, the number of seats in the U.S. House of Representatives that are allocated to the state is likely to change based on the results of the census currently being conducted, thereby changing the number of congressional districts in the state; and WHEREAS, the latest federal decennial census figures may have a dramatic and upending effect on past and future policy decisions of the legislature by altering the applicability of various provisions of law; and WHEREAS, these population range provisions and provisions based on the number of congressional districts in the state should be identified prior to the next legislative session ENROLLEDHR NO. 126 Page 2 of 2 and amended in that session in order to ensure the constancy of legislative policy determinations after the latest federal decennial census results become effective. THEREFORE, BE IT RESOLVED that the House of Representatives of the Legislature of Louisiana does hereby request the House Executive Committee to direct House Legislative Services staff to study population range provisions and provisions based on the number of congressional districts in the state in the state constitution and in the revised statutes and to report their findings to the House of Representatives prior to the convening of the 2011 Regular Session of the Legislature.
